APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR MUSKEGO
LAKES MIDDLE SCHOOL LOCATED IN THE NE ¼ OF SECTION 13
(TAX KEY 2209.999 & 2209.987 / W124 S8009 NORTH CAPE ROAD &
S81 W124904 HI VIEW DRIVE)
WHEREAS, A submittal was received from Bray Architects and the Muskego Norway School
District (MNSD) for a Building, Site, and Operation Plan Amendment approval located at W124
S8009 North Cape Road & S81 W12904 Hi View Drive (Tax Key Nos. 2209.999 & 2209.987),
and
WHEREAS, In an effort to ensure the safety of the students and staff of the Muskego Lakes
Middle School, the City, the Police Department, and the Fire Department determined that a
secondary emergency access was necessary for access to the new school, and
WHEREAS, A proposal has now been submitted to add an emergency access driveway along the
south side of the new school site, and
WHEREAS, The school district is in the process of purchasing a residential lot and home in which
they are proposing to locate the emergency access driveway though, and
WHEREAS, A 75-foot wide easement or access way is proposed along the western portion of the
residential lot and it is proposed to contain a 12-foot wide asphalt driveway with 4-foot shoulders
on each side of the driveway, and
WHEREAS, Said access width has been widened from 60-feet to 75-feet in order to be able to
shift the driveway eastward to be able to preserve more landscaping and to minimalize the visual
impact to the western neighbor, and
WHEREAS, The access driveway would not be used for daily use as it will be gated so that it can
only be used for emergency situations, and
WHEREAS, The school district will maintain the access driveway all year round , including
plowing, and
WHEREAS, The school district is considering re-selling the single-family home after the access
driveway has been established and said driveway would be protected within an easement or
separate lot.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and
Operation Plan amendment located at W124 S8009 North Cape Road & S81 W12904 Hi View
Drive (Tax Key Nos. 2209.999 & 2209.987).
BE IT FURTHER RESOLVED, The driveway and general access area must be fully maintained
(plowing and mowing) and fully accessible to emergency personnel at all times.
BE IT FURTHER RESOLVED, All efforts must be taken to minimalize impacts to existing trees
and landscaping on site.
BE IT FURTHER RESOLVED, As part of the permitting process, a tree removal exhibit must be
provided to ensure as much tree protection as possible.
BE IT FURTHER RESOLVED, The installation of the access driveway cannot cause any
drainage issues onto adjacent properties.
BE IT FURTHER RESOLVED, Detailed construction/grading plans will need to be reviewed by
engineering staff before any permits are issued for this work to ensure all drainage regulations
are being followed.
BE IT FURTHER RESOLVED, If there are any substantial changes, as determined by City staff,
when construction permits are submitted, Plan Commission re-review may be required.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise
authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
