PCR2017044 Gemini Drive VacationRESOLUTION #P.C.044-2017 RECOMMENDATION TO COMMON COUNCIL TO VACATE A PORTION OF THE RIGHT-OF- WAY OF GEMINI COURT LOCATED IN THE NW ¼ OF SECTION 16 (TAX KEY NO. 2222.984.006 / GEMINI COURT) WHEREAS, On June 7, 2017 a request was submitted by Wayne Straus, 4Front Engineered Solutions for a Right-of-Way vacation located in the NW ¼ of Section 16 (Gemini Ct. / Tax Key Number 2222.984.006), and WHEREAS, The section of the Gemini Drive right-of-way currently contains a cul-de-sac that is used for access to 4Front Engineered Solutions, and WHEREAS, The right-of-way vacation is being requested so that the cul-de-sac can be relocated slightly to the northeast within right-of-way that will be newly dedicated as part of a separate CSM, and WHEREAS, The owner/builder will be required to design and construct all required improvements, to City standards, in the right-of-way for the new cul-de-sac, and WHEREAS, The Public Works Committee and Common Council require review of the vacation before official approvals can be given, and WHEREAS, The Community Development Department does not see any problems with the requested vacation. THEREFORE BE IT RESOLVED, The Plan Commission approves the Right-of-Way Vacation located in the NW ¼ of Section 16 (Gemini Ct. / Tax Key Number 2222.984.006). BE IT FURTHER RESOLVED, All roadway alterations and new roadway construction must be reviewed by the City to ensure compliance with all City regulations.
