PCR2013030RESOLUTION #P.C. 030-2013 APPROVAL OF AN ACCESSORY STRUCTURE FOR THE PALMER PROPERTY LOCATED IN THE SE ¼ OF SECTION 2 (TAX KEY NO. 2168.106 / S70 W14463 CATALINA DRIVE) WHEREAS, A site plan and building drawings were submitted by Dan Palmer to construct a 320 square foot accessory structure on their property located at S70 W14463 Catalina Drive (Tax Key No. 2168.106), and WHEREAS, The property is zoned RS-3, Suburban Residence District and said structure is a permitted accessory use and subject to Plan Com mission review since it’s a 2nd accessory structure, and WHEREAS, There is an existing house on the property with one other accessory structure (detached garage), and WHEREAS, The existing accessory structure is 800 square feet in size and it will remain on the property, and WHEREAS, The total allowed square footage for accessory structures on t his property is limited to 1,232 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, The colors of the new accessory structure is proposed to match the colors of the home, and THEREFORE BE IT RESOLVED, That the Plan Commission approves a 320 square foot second accessory structure submitted by Dan Palmer for the property located at S70 W14463 Catalina Drive (Tax Key No. 2168.106) subject to the following: BE IT FURTHER RESOLVED, That the building cannot be used for the operations of a business. BE IT FURTHER RESOLVED, That the floor of the accessory structure must be asphalt, sealed concrete block, or concrete slab per the Zoning Code and it must meet all applicable building codes. BE IT FURTHER RESOLVED, That the colors of the new accessory structure must be similar to the colors of the house. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
