APPROVAL OF A CONDITIONAL USE GRANT AND BUILDING, SITE, AND OPERATION PLAN
FOR FOX RIVER CHRISTIAN CHURCH LOCATED IN THE SE ¼ OF SECTION 5
(TAX KEY 2180.994.001 / S67 W19491 TANS DRIVE)
WHEREAS, On January 4, 2013 a submittal was received from Groth Design Group for the Fox
River Christian Church property located at S67 W19491 Tans Drive (Tax Key No. 2180.994.001),
and
WHEREAS, The Fox River Christian Church is requesting to be able to use this property as a
church/religious institution, and
WHEREAS, The property is zoned B-2, Local Service Center District, and the church/religious
institution use requires a Conditional Use Grant (CUG) that must receive approval through the
Plan Commission, and
WHEREAS, A Public Hearing was held on February 5, 2013 in front of the Plan Commission for
the proposed use, and
WHEREAS, The property currently contains one large building which previously contained a
movie theatre, a bar/restaurant, and a teen night club, and
WHEREAS, There is a large parking lot on the east side of the building with ample parking for the
proposed use, and
WHEREAS, There are plans to renovate the interior of the space to accommodate the new needs
of the church, including a large worship space, class rooms, offices, a nursery, and receptionist
space, and
WHEREAS, The proposed worship space being created will accommodate 345 people, and
WHEREAS, The plans include the removal of some existing windows and closing of the openings
with matching masonry, and
WHEREAS, There is the possibility of painting the entire structure, but it is unknown at this time if
there will be the budget for that, and
WHEREAS, There is an existing CUG on this property for the use as a movie theatre, but since
that use is no longer present, there is no longer a need for the previous CUG, and
WHEREAS, The removal of a CUG can be done by approval of a Plan Commission Resolution
stating such and filing of the proper paperwork, and
WHEREAS, This site has been vacant and unkempt for a while and as such the site is in need of
upkeep, clean-up, and landscape maintenance, and
WHEREAS, No new signage, lighting, or other site changes are proposed at this time.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conditional Use
Grant and Building, Site, and Operation Plan for the operation of a church/religious institution for
Fox River Christian Church located at S67 W19491 Tans Drive (Tax Key No. 2180.994.001).
BE IT FURTHER RESOLVED, That the approval of this Resolution will remove the previous CUG
for a movie theatre use on this property.
BE IT FURTHER RESOLVED, That the former window areas that are being patched must
contain masonry units that match the surrounding and these areas must be painted to match the
existing/surrounding building colors.
BE IT FURTHER RESOLVED, That if the building is going to be repainted the same color or an
earth-tone color, this review/approval can occur by planning staff.
BE IT FURTHER RESOLVED, That any signage, temporary or permanent, will require a separate
sign permit.
BE IT FURTHER RESOLVED, That any lighting or other site changes will need Plan Commission
or planning staff approvals.
BE IT FURTHER RESOLVED, That all landscape areas, including all landscape islands, need to
be cleaned up and refreshed by June 1, 2013 and in perpetuity into the future.
BE IT FURTHER RESOLVED, The following landscape items must be completed as noted
above:
1. All landscape areas, including landscape islands within the parking lot, must be kept
weed free, and
2. All areas of exposed landscape fabric must be correct so that the landscape fabric is not
visible, and
3. All mulched areas must be re-mulched as to provide ample ground cover, and
4. All landscaping/plantings must be trimmed/pruned as needed, and
5. Any dead or dying landscaping/plantings must be replaced with like vegetation.
BE IT FURTHER RESOLVED, That any debris scattered around the site and in the parking lot
must be removed by the time occupancy is requested.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
