PCR2012051AMENDED RESOLUTION #P.C. 051-2012 APPROVAL OF A BUILDING, SITE, AND OPERATION PLAN AMENDMENT FOR NATURESCAPES SELF-STORAGE PROPERTY LOCATED AT S82 W18653 GEMINI DRIVE (TAX KEY NO. 2222.984.011) WHEREAS, A request to amend the Building, Site, and Operation Plan for Naturescapes Self Storage has been submitted by Todd Furry the property located at S82 W18653 Gemini Drive (Tax Key 2222.984.011), and WHEREAS, The original plan showed the entire property being fenced, as is typically done on most mini- storage properties, and WHEREAS, Since that time the petitioner realized they can meet their security needs by fencing the east side (already existing) and the driveway entry (via a gate) and now requests leaving the north, south, and west lot lines unfenced since there are bio retention swales and/or drainage ditches on these sides, and WHEREAS, The petitioner also requests to deviate from the originally approved landscape plan to allow mulching the east and west sides of the property instead of covering these areas with grass, and THEREFORE BE IT RESOLVED, That the Plan Commission approves an amended Building, Site and Operation Plan for Naturescapes Self Storage located at S82 W18653 Gemini Drive (Tax Key 2222.984.011). BE IT FURTHER RESOLVED, That typical landscape plans call for grass areas and not larger mulch areas, however the proposed mulching can still look aesthetically pleasing if maintained appropriately. BE IT FURTHER RESOLVED, That all mulching areas on the property shall be replaced with two fresh coats of mulch two (2) times a year and the petitioner should let the Community Development Department know when the fresh coats are applied and CDD staff shall complete an onsite inspection to verify the new mulch. BE IT FURTHER RESOLVED, That all mulch areas shall be free from weed growth at all times. BE IT FURTHER RESOLVED, That these newly approved mulch areas can be regular mulching material. However, the bio retention swales still must only have hardwood mulch without any vegetation material that can easily be swept away. BE IT FURTHER RESOLVED, That Community Development Department staff have the authority to bring this issue before the Planning Commission if the landscape guidelines aren’t followed and Planning Commission then may require changes back to original approvals if issues exist. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
