PCR2012046AMENDED RESOLUTION #P.C. 046-2012 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR A RETAIL CONVENIENCE CENTER LOCATED IN THE SW ¼ OF SECTION 2 (NE CORNER OF MOORLAND-JANESVILLE / TAX KEY NOS. 2167.994 AND 2167.993) WHEREAS, On August 27, 2012 plans were submitted by Briohn Design Group for a Building, Site and Operation Plan for a new Retail Convenience Center located in the SW ¼ of Section 2 (NE Corner of Moorland-Janesville Road / Tax Key Nos. 2167.994 and 2167.993), and WHEREAS, Said property is currently zoned B-3 General Business District, and said use is a permitted use within this zoning district, and WHEREAS, The 2020 Comprehensive Plan shows this property as commercial uses and the proposal is consistent with the plan, and WHEREAS, The proposal is to build a Retail Center totaling 8,526 square feet situated on a 1.04 acre site, and WHEREAS, This site is governed by the General Design Guide and the Moorland South Design Guide, and WHEREAS, The General Design Guide calls for 50% masonry product and the proposed structure meets this main requirement, and WHEREAS, The Moorland South Design Guide looks to promote structures with Craftsman and Prairie Style Architecture and the developers met these requirements in a variety of ways, and WHEREAS, The building materials consist of architectural concrete brick, stone veneer, and fiber cement board siding, and WHEREAS, A hipped roof encircles the building, occasionally interrupted with raised parapets and tower elements and brick colors transition at these elements with the two main tower elements along the south façade enhanced with stone veneer piers, and WHERAS, Areas of fiber cement board siding accent the towers and serve as backdrop for signage, and WHEREAS, Large areas of glazing will occur on the highly visible South, West, and East facades and the glazing will be gray-tinted high performance glass in a factory painted aluminum frame system, and WHEREAS, The building height is proposed as 17’ 4” to top of hipped roof and this will create a “well” that hides potential roof top equipment from view, and WHEREAS, The colors of the structure are shown to be a variety of earth tones, and WHEREAS, The site was previously made up of two past houses that were removed earlier this year and the developer is working on acquiring a .3 acre portion of the Moorland Road right-of- way from Waukesha County to make the site the fully proposed 1.04 acres, and WHEREAS, The submittal includes a Quit Claim Deed that the developer is currently negotiating with the County for the purchase, and WHEREAS, Vehicular access meets code throughout the site as two-way drive aisles are at least 24 feet in width, and WHEREAS, One area of note is on the north side of the building where there is a two -way access lane along a possible future drive thru lane and the proposed layout shown in this submittal should provide good access for vehicles, and WHEREAS, A patio area is shown in front of the southern façade tenant spaces which should produce a nice area for patrons to enjoy future merchants on this highly visible corner in Muskego, and WHEREAS, External Access to the site is shown to occur as a right in/right out access off of Janesville Road and an internal access point to the Kohls Department Store complex and the access off of Janesville Road is still pending Waukesha County approval, and WHEREAS, Vehicular access to the site is shown to occur as a right in/right out access off of Janesville Road (pending approval from Waukesha County) and an internal access point to the Kohl’s Department Store complex, and WHEREAS, Parking is shown as 47 stalls all meeting the city code dimensions of 10’x20’, and WHEREAS, The amount of parking stalls provided exceeds typical code requirements for a planned shopping center facility as Muskego typically ensures that half a planned shopping center is considered as customer floor area (1 stall is required per 150 SF of customer floor area; half the building equals 4,263 SF requiring at least 28 parking stalls), and WHEREAS, The site and building plans are subject to Fire Department approvals, and WHEREAS, A dumpster enclosure is proposed along the northeast portion of the site and the enclosure will be constructed of similar materials to the overall structure, and WHEREAS, A landscape plan has been submitted as part of the proposal and review is pending, and WHEREAS, A wealth of landscaping is proposed in the new parking lot, along the foundations of the entire structure, and along the Moorland Road and Janesville Road rights-of-ways, and WHEREAS, No exact signage is part of the submittal and will be subject to future staff approvals, and WHEREAS, Site lighting is proposed to match the existing lighting found around the Kohl’s Department Store complex, and WHEREAS, A photometric plan has been submitted and shows appropriate lighting levels per code, and WHEREAS, The development will be served by existing public sanitary sewer and water, and WHEREAS, All stormwater arrangements have been accommodated for when the Kohl’s Department Store development was constructed. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan for a retail convenience center submitted by Briohn Design Group for a property located in the SW ¼ of Section 2 (Moorland-Janesville Road / Tax Key Nos. 2167.994 and 2167.993). BE IT FURTHER RESOLVED, A separate sign permit will be required before any signage (temporary or permanent) can be installed and this includes any signage on the building. BE IT FURTHER RESOLVED, That in the event the purchase of land doesn’t work out with Waukesha County that the proposed development m ay require re-approval from the Planning Commission as the site plan and proposed building would be substantially affected. BE IT FURTHER RESOLVED, The site plan is still subject to Fire Department approvals at the time of building permits. BE IT FURTHER RESOLVED, All lighting fixtures must be full cut-off with a zero degree tilt and the concrete bases for the pole lights cannot exceed 6 inches in height above grade. BE IT FURTHER RESOLVED, Metal Halide lighting may be installed if desired by the developer. BE IT FURTHER RESOLVED, A final landscape plan will need to be approved by the City Forester prior to the issuance of building permits. BE IT FURTHER RESOLVED, That pine trees from the vision corners along the internal northern access to the property shall removed and this should be shown on the final landscape plan approval. BE IT FURTHER RESOLVED, Formal approvals from the Engineering Division of grading and stormwater plans will be required before the issuance of building permits along with possible amendments to stormwater management agreements for the existing stormwater pond. BE IT FURTHER RESOLVED, That any bollards must be painted to m atch the colors of the principal structure. BE IT FURTHER RESOLVED, That any new handicap signs be incorporated into bored bollards. BE IT FURTHER RESOLVED, That all roof top and ground mechanicals (including HVAC devices, electrical transformers, etc.) must be screened from view and/or incorporated into the design of the site/structure (screening, etc.) and should be approved by the Community Development Department. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
