RESOLUTION #043-2020
APPROVAL OF KWIK TRIP
DEVELOPER’S AGREEMENT
WHEREAS, Kwik Trip, Inc. and the City of Muskego wish to enter into a Developer’s
Agreement regarding a new Kwik Trip Convenience Store and Gas Station to be located
at the intersection of Janesville Road and College Avenue in the City of Muskego; and
WHEREAS, The Developer’s Agreement is for the construction of public water main
improvements at said location; and
WHEREAS, The City of Muskego will reimburse Kwik Trip, Inc. an estimated amount of
$68,168.24 to upgrade the watermain from an 8” pipe to a 16” pipe to allow for future
water service in the City of Muskego; that the total amount will be determined based on
actual watermain construction in the field; and
WHEREAS, The Finance Committee has reviewed and recommended approval of the
Agreement between Kwik Trip, Inc. and the City of Muskego to make and install said
public improvements reasonably necessary for the Development, conditioned upon the
construction of said Improvements according to approved plans, applicable City
ordinances and written municipal specifications universally applied as of the date of the
Agreement.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve
the attached Developer’s Agreement between Kwik Trip, Inc. and the City of Muskego.
BE IT FURTHER RESOLVED That the Mayor and Clerk-Treasurer are hereby
authorized to sign the Agreement and the City Attorney is authorized to make
substantive changes to it as may be necessary in order to preserve the general intent
thereof.
