CCR2020026-Emergency Responder Sick Leave Policy COMMON COUNCIL – CITY OF MUSKEGO RESOLUTION #026-2020 Resolution to Adopt an Emergency Responder Sick Leave Policy Due to the Covid-19 Pandemic WHEREAS, in December 2019, a novel strain of the coronavirus was detected, now named COVID-19, and it has spread throughout the world, including every state in the United States; and WHEREAS, on January 3, 2020, the World Health Organization declared COVID-19 to be a Public Health Emergency of International Concern; and WHEREAS, on March 12, 2020, Governor Tony Evers declared a public health emergency to direct all resources needed to respond to and contain COVID-19 in Wisconsin; and WHEREAS, on March 13, 2020, President Donald Trump proclaimed a National Emergency concerning COVID-19; and WHEREAS, on March 18, 2020, President Donald Trump signed the Families First Coronavirus Response Act (“FFCRA”), which expands the Family and Medical Leave Act (Emergency Family and Medical Leave Expansion Act), and creates a paid sick leave entitlement for certain eligible employees (Emergency Paid Sick Leave Act); and WHEREAS, the provisions of the FFCRA allows employers to exempt “emergency responders” and “health care provider” from provisions of the FFCRA; and WHEREAS, on March 30, 2020, the City of Muskego Common Council passed Resolution #023-2020 which adopted an Emergency Paid Sick Leave Policy in compliance with the FFCRA; and WHEREAS, on March 30, 2020, the City of Muskego Common Council passed Resolution #024-2020 which designated various city employees as “Emergency Responder” with regard to implementation of the FFCRA; that said employees are not eligible for the entitlements contained within the EPSLA due to their designated status; and WHEREAS, for employees who are classified as Emergency Responders and exempted from the EPSLA provisions of the FFCRA and who are eligible for paid sick leave under the City of Muskego’s current personnel policies, at this time, the City wishes to provide certain sick leave benefits as a result of the COVID-19 pandemic. NOW, THEREFORE, BE IT RESOLVED that the Emergency Responder Sick Leave Policy, a copy of which is attached hereto, is hereby adopted in its entirety. DATED THIS 14th DAY OF APRIL 2020.
