RESOLUTION #033-2017
CITY’S CONSENT TO A PROPOSED PARCEL DEVELOPMENT AGREEMENT FOR LOT 3,
MEMORANDUM OF PARCEL DEVELOPMENT AGREEMENT AND
AGREEMENT WITH SELLER ON DEVELOPMENT LOT 3
IN TAX INCREMENTAL DISTRICT #11
WHEREAS, The City of Muskego entered into a Tax Incremental Development Agreement with
Developer, Parkland Towne Center Development, Inc., on June 30, 2016; and
WHEREAS, The Development Agreement states that any assignment of certain terms of the
Agreement to individual parcel owners, under a Parcel Development Agreement between the
Developer and each separate parcel developer/owner, is subject to written approval by the
City; and
WHEREAS, The Developer has entered into a Parcel Development Agreement with a parcel
developer, Landmark Credit Union, for Lot 3 of the development; and
WHEREAS, The City along with outside counsel have reviewed the attached Parcel
Development Agreement Lot 3, the Memorandum of Parcel Development Agreement and the
Agreement with Seller on Development Lot 3, are satisfied that the Agreements are in the best
interests of the City and recommend that the City consent to the Agreements.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego,
does hereby consent to the Agreements noted above and hereby authorizes the Mayor and
Deputy Clerk to sign the necessary documents to accomplish the same.
BE IT FURTHER RESOLVED That the City Attorney be and is hereby authorized to make such
substantive changes, modifications, additions and deletions to and from the various provisions
of said Agreements and similar Agreements, including any and all attachments, exhibits,
addendums and amendments, as may be necessary and proper to correct inconsistencies,
eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and
maintain the general intent thereof, and to prepare and deliver such other and further
documents as may be reasonably necessary to complete the transactions contemplated
herein.
