APPROVAL OF A CONDITIONAL USE GRANT
FOR A GUEST HOUSE ON THE RICCO PROPERTY
(TAX KEY 2263.998.003 / W151 S10178 THODE DRIVE)
WHEREAS, On November 28, 2005 plans were submitted by Ron and Belinda Ricco for
a Conditional Use Grant for the conversion of an existing barn into a Guest House for a
property located in the SW ¼ of Section 26 (Tax Key No. 2263.998.003 / W151 S10178
Thode Drive), and
WHEREAS, Said property is currently zoned A - Agricultural District, and said use is a
permitted use by Conditional Use Grant, and
WHEREAS, A Conditional Use Grant requires a Public Hearing and the hearing was
scheduled for January 17, 2006, and
WHEREAS, The primary residential structure is located to the east end of the property,
and is classified as a conforming structure, and
WHEREAS, The petitioner requests that the secondary residential structure be classified
as a Guest House pursuant to Section 17:8.01(C)(12) of the Zoning Code, which permits
guest houses on lots of at least 120,000 square feet provided such structure shall not be
rented or leased and such structure shall be a minimum of 1,200 square feet, and
WHEREAS, The Guest House meets the 1,200 square foot minimum size requirement,
and
WHEREAS, The parcel meets the 120,000 square foot minimum lot size requirement,
and
WHEREAS, The renovation of the barn will include the addition of a deck.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conditional
Use Grant for the conversion of an existing barn into a Guest House for a property
located in the SW ¼ of Section 26 (Tax Key No. 2263.998.003 / W151 S10178 Thode
Drive).
BE IT FURTHER RESOLVED, That the Guest House shall not be rented or leased, and
shall only be occupied in accordance with Section 17:8.01(C)(12) of the City of Muskego
Zoning Code.
BE IT FURTHER RESOLVED, That Guest House shall meet all building and zoning
requirements at the time of permitting.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan shall be maintained in perpetuity unless
otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, Where uses authorized by this Conditional Use Grant are
discontinued for a period of twelve (12) consecutive months or are discontinued for
eighteen (18) cumulative months in any three (3) year period, the Conditional Use Grant
shall expire and this approval shall be null and void.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal
action, or both.
