PCR2005142RESOLUTION #P.C. 142-2005 APPROVAL OF A CONCEPTUAL PLAT AND CONCEPTUAL REZONING FROM RS-2 SUBURBAN RESIDENCE TO RS-3/OPD SUBURBAN RESIDENCE DISTRICT WITH A PLANNED DEVELOPMENT OVERLAY DISTRICT FOR THE FUTURE BELLE CHASSE SUBDIVISION LOCATED IN THE SE ¼ AND SW ¼ OF SECTION 11 (TAX KEY NOS. 2203.990, 2203.990.001 AND 2204.996 / DURHAM DRIVE) WHEREAS, On November 21, 2005 plans were submitted by Bill Carity for a Conceptual Plat and Conceptual Rezoning for what will be known as the future Belle Chasse Subdivision, located in the SE ¼ and SW ¼ of Section 11, and WHEREAS, The proposed plat is situated on 110 acres bisected by Durham Drive located just south of McShane Drive and is comprised of open lands, wetlands, and forested areas, and WHEREAS, The proposed plat consists of 147 parcels of at least 14,000 square feet and 90 feet in width each, and WHEREAS, Said property is currently zoned RS-2 Suburban Residence District, and the proposed plat configuration requires a rezoning to RS-3 / OPD Suburban Residence District with Planned Development Overlay District and the plat appears to meet these requirements, and WHEREAS, The OPD is in place to allow reduced lot sizes, width, and setbacks of parcels and final OPD allowances will be made at the time of preliminary and final plat times, and WHEREAS, The 2010 Comprehensive Plan depicts the area for medium density residential development consistent with the RS-2 or RS-3 zoning districts and a density not to exceed 1.6 to 2.99 units an acre, and WHEREAS, The proposed development is within the guidelines of the 2010 Comprehensive Plan and the proposed density meets the City’s requirement for low-density residential as the proposal shows 1.37 dwelling units an acre, which is less than what is required, and WHEREAS, The adopted Conservation Plan depicts high acquisition priority areas and the Conservation Commission will review the plat and recommend changes before the preliminary plat at an upcoming meeting, and WHEREAS, The adopted Park and Open Space Plan depicts a future recreation trail along Durham Drive and the Park Board will review the plat and recommend any changes before the preliminary plat at an upcoming meeting, and WHEREAS, The 2010 Street System Plan depicts Durham Drive to be realigned with a 100 foot right-of-way and the proposal depicts this dedication, and WHEREAS, The Public Works and Utilities Committees will review the plat and recommend any changes before the preliminary plat at an upcoming meeting and specific determinations will be made regarding the future realignment of Durham Drive and the future infrastructure needs of both the development and the surrounding area of the City, and WHEREAS, All other roadways in the development are proposed to be public streets constructed to City standards, and WHEREAS, The dwelling units will be serviced by municipal sanitary sewer and public water. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Conceptual Plat and Conceptual Rezoning for what will be known as the future Belle Chasse Subdivision, located in the SE ¼ and SW ¼ of Section 11. BE IT FURTHER RESOLVED, The Plan Commission will be receptive to a rezoning to include RS-3 / OPD zoning on the subject property as it meets and exceeds the requirements of the 2010 Comprehensive Plan. BE IT FURTHER RESOLVED, That all boards and committees mentioned above must review the conceptual plat before a preliminary plat comes forward in order to assure future compliance of all infrastructure, recreation, and environmental areas. BE IT FURTHER RESOLVED, That the Planning Commission recommends that the future realignment of Durham Drive timing be solidified and that the designing begin as a substantial cost savings could result as part of this development in regards to land acquisition and stormwater retention sharing. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
