PCR2005141AMENDED RESOLUTION #P.C. 141-2005 APPROVAL OF AN ADDITITONAL ACCESSORY STRUCTURE FOR THE CEBALLOS PROPERTY LOCATED IN THE NE ¼ OF SECTION 11 (TAX KEY NO. 2201.090 / S73 W1114270 WOODS ROAD) WHEREAS, On November 18, 2005 a site plan and building drawings were submitted by Amy Ceballos to construct a 1,160 square foot accessory structure (29’ x 40’) on the property located at S73 W14270 Woods Road, and WHEREAS, The property is zoned RS-2 and RS-3 Suburban Residence Districts, and where said structure is a permitted accessory use and subject to Plan Commission review due to more than one accessory structure on the lot as per design guidelines for residential uses, and WHEREAS, A 61.3’ x 35.7’ accessory structure (barn) and a home residence all currently reside on the property, and WHEREAS, The total square footage for accessory structures on this property is limited to 2,637 square feet, and said proposal meets the bulk requirements of the Zoning Code except the size limit, and WHEREAS, The combined total of both accessory structures will be 3,348 square feet, which will be 711 square feet over the allowed limit, and WHEREAS, The square footage proposed, a variance from the Zoning Board of Appeals would be required, and WHEREAS, The structure is proposed to be constructed with vinyl siding and a slate like shingled roof and said proposal does meet the Plan Commission’s standards for administrative approval of residential accessory structures as the siding and roof materials do match the materials used on the primary residence, and WHEREAS, The proposed height will be fourteen (14) feet, as measured by code, and this is allowed by right. THEREFORE BE IT RESOLVED, That the Plan Commission approves a 1,160 square foot accessory structure submitted by Amy Ceballos for the property located at S73 W14270 Woods Road. BE IT FURTHER RESOLVED, That in order to be allowed the additional accessory structure of 1,160 square feet, a variance for 711 square feet would need to be successfully granted by the Zoning Board of Appeals and an appropriate hardship would need to be demonstrated as per the Municipal Code. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That accessory structure will be used to house personal vehicles and restore old vehicles.
