PCR2005140RESOLUTION #P.C. 140-2005 APPROVAL OF A CONCEPTUAL TWO (2) LOT LAND DIVISION FOR THE KINDLER PROPERTY LOCATED IN THE NW ¼ OF SECTION 31 (TAX KEY NO. 2282.996 & 2282.995 / KELSEY DRIVE) WHEREAS, On November 16, 2005 a Conceptual Certified Survey Map was submitted by Wayne Salentine on behalf of James Kindler for a five (5) lot land division of the property located in the NW ¼ of Section 31, (Tax Key No. 2282.996 & 2282.995 / Kelsey Drive), and WHEREAS, Said property is zoned A Agricultural District requiring minimum lot size of 120,000 square feet and an average minimum width of 300 feet and parcels meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for open and agricultural lands and medium density residential and this proposal is within this goal, and WHEREAS, The conceptual CSM contains four (4) buildable lots along with one (1) outlot, and WHEREAS, The CSM depicts land dedications for rights-of-way that do not conform with the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by private on-site sewer systems and private water facilities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conceptual Certified Survey Map submitted by Wayne Salentine on behalf of James Kindler for a five (5) lot land division of the property located in the NW ¼ of Section 31, (Tax Key No. 2282.996 & 2282.995 / Kelsey Drive). BE IT FURTHER RESOLVED, That the following items need to be handled for the final Certified Survey Map, • Any wetlands on the CSM need to be delineated. If there are none present, a qualified wetland consultant must verify this. Also, concurrence will be needed from the DNR for any wetlands that may be on the site, • Since this area is shown on our Conservation Plan as a low management priority area, all environmental features will need to be delineated on the final CSM. This should also include illustrating specific building pads and identifying all other environmentally significant lands in conservation easements, • The CSM will need to be achieved with two separate CSM’s. A single CSM can only illustrate 4 parcel. The remnant that Lot 4 is being divided from does not need to be shown on the final CSM if it is 20 acres or more in size, • All existing and proposed easements must be shown on the final CSM. This includes the known gas line easement and the known access easement for the parcel to the west, • A note should be placed on the final CSM stating what will happen with and who will own Outlot 1, • The Ordinary High Water Mark (O.H.W.M.) of any water features that may be on the property must be delineated on the final CSM, • The Public Works department will need to review the proposed right-of-way for this CSM before the final CSM is recorded. They will need to determine if the proposed right-of-way can be public or private and if the configuration of the end of the right-of- way can be as proposed or if a cul-de-sac bulb will be required (For emergency vehicles purposes). BE IT FURTHER RESOLVED, An ultimate right-of-way dedication of 100 feet will be need along Kelsey Drive. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
