PCR2005139RESOLUTION #P.C. 139-2005 APPROVAL OF A CONCEPTUAL TWO (2) LOT LAND DIVISION FOR THE HENNEBERRY PROPERTY LOCATED IN THE NE ¼ OF SECTION 29 (TAX KEY NO. 2273.998 / W192 S9555 RACINE AVENUE) WHEREAS, On November 18, 2005 a Conceptual Certified Survey Map was submitted by Richard Henneberry for a two (2) lot land division of the property located in the NE ¼ of Section 29, (Tax Key No. 2273.998 / W192 S9555 Racine Avenue), and WHEREAS, Said property is zoned R-1 Country Home District requiring minimum lot size of 80,000 square feet and an average minimum width of 200 feet and parcels meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for open and agricultural lands and this proposal is within this goal, and WHEREAS, The CSM depicts land dedications for rights-of-way in conformity with the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by private on-site sewer systems and private water facilities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conceptual Certified Survey Map submitted by Richard Henneberry for a two (2) lot land division of the property located in the NE ¼ of Section 29, (Tax Key No. 2273.998 / W192 S9555 Racine Avenue). BE IT FURTHER RESOLVED, That the following items need to be handled for the final Certified Survey Map, • Before the recording of the final CSM the City needs a letter of concurrence from the DNR for the wetland delineation, • The existing accessory structure that will remain on Lot 2 will have to be at least 30 feet away from any newly created lot lines. If this requires that the existing mound system be placed across a lot line, that may be acceptable as along as there is an easement covering the mound area on Lot 2, • There must be a note on the final CSM that states that if there is not a principal structure (house) associated with Lot 2 within one year of the recording of the land division, the accessory structure on Lot 2 must be removed, • The Ordinary High Water Mark (O.H.W.M.) of the pond and any other navigable waterways on the property must be delineated on the final CSM. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
