PCR2005138a AMENDED RESOLUTION #P.C. 138-2005 APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP FOR THE JAMES / DOVIC PROPERTY LOCATED IN THE NW ¼ OF SECTION 14 (MYSTIC DRIVE / TAX KEY NO. 2214.997) WHEREAS, On November 18, 2005 a Certified Survey Map was submitted by Gail James for a two (2) lot land division located in the NW ¼ of Section 14, (Mystic Drive / Tax Key No. 2214.997), and WHEREAS, The proposed land division would create two lots with sizes of at least 217,800 square feet and minimum widths of 220 feet, and WHEREAS, Said property is zoned RS-2 – Suburban Residence District, requiring minimum lot sizes of 40,000 square feet and average minimum widths of 220 feet, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for medium density residential development, and this proposal is consistent with this goal, and WHEREAS, All lots will be serviced with private wells and all lots will be served by private on-site sewer systems, and WHEREAS, A 30-foot right-of-way dedication is currently shown on the CSM and a larger dedication may be needed, and WHEREAS, There are no wetlands present on Lot 1, but they may be present on the remnant parcel., and WHEREAS, The petitioner submitted a letter to the Planning Department on January 5, 2006 stating that they would like to withdraw their land division submittal and request to be removed from all agendas and committees at this time. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map submitted by Gail James for a two (2) lot land division located in the NW ¼ of Section 14, (Mystic Drive / Tax Key No. 2214.996), subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a 60-foot right-of-way dedication is needed for access to Parcel 1, rather than the 30-foot dedication shown on the current CSM. BE IT FURTHER RESOLVED, That the Public Works Committee will have to review the CSM before recording can occur in order to discuss if any right-of-way improvements will be required. BE IT FURTHER RESOLVED, That the large remnant parcel must be shown on the CSM with all wetlands and ingress/egress easements. BE IT FURTHER RESOLVED, That all technical corrections will need to be addressed before the CSM will be signed and recorded. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution #196-2002.
