APPROVAL OF FINAL PLAT FOR THE COPPER OAKS SUBDIVISION (F.K.A. VALLEY
VIEW ESTATES) LOCATED IN THE SE ¼ OF SECTION 4
(MARTIN DRIVE / TAX KEY NO. 2173.991)
WHEREAS, On October 3, 2005 a Final Plat of Copper Oaks Subdivision was submitted by Glen
Miller for the property located in the SE ¼ of Section 4, and
WHEREAS, Said plat proposes 26 lots consisting of 20 single-family lots ranging from 20,000
square feet to 64,000 square feet, and 6 outlots, and
WHEREAS, The area of the proposed development is zoned RS-2/OPD Suburban Residence
District, which require a minimum lot size of 20,000 square feet and minimum width of 110 feet,
and said lots meet these zoning requirements, and
WHEREAS, Outlots 1-5 will be owned and maintained by the adjoining parcel owners although
preservation easement s will govern these outlots, and
WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission's previously
approved Preliminary Plat and Detailed Site Analysis, under Resolution #P.C. 120-2005, and
WHEREAS, The 2010 Land Use Plan shows the area as low-density residential permitting
approximately 0.5 to 0.7 units an acre, and the plat meets this requirement, and
WHEREAS, The Conservation Plan depicts Medium Management priorities on the plat that
appear to run along the southern tree line and Conservation Commission recommends that
preservation restrictions are put on the areas south of the building restriction lines of Lots 6-10
and these have not been incorporated as of yet, and
WHEREAS, Park Arthur lies north of the subject property and Park Board recommendations are
to incorporate a trail along Martin Drive as per the adopted Park and Open Space Plan and the
trail is incorporated into the petitioner’s approved construction plans, and
WHEREAS, The Public Works Committee reviewed the need for Rossmar Drive to connect to
Copper Oaks and the Committee believed that the there was no need for the Drive to connect,
although they did recommend a pedestrian easement be established and that is noted on the Final
Plat, and
WHEREAS, The petitioner is working with the Engineering Department to vacate a portion of
the Martin Drive right-of-way (ROW) along Lots 4 and 5 as this portion of ROW is not needed
for the future width of the roadway, and
WHEREAS, The Plan Commission has found that the plat is consistent with the adopted
Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street
System Plan, and
WHEREAS, Said parcels will be serviced by City sewer and private water, and
WHEREAS, Stormwater management will be accommodated on Outlot 6.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the
Common Council of a 26 lot Final Plat for the Copper Oaks Subdivision, located in the SE ¼ &
of Section 4.
BE IT FURTHER RESOLVED, That Street Tree and Landscape Plans shall be approved by the
Planning Department prior to release of Building Permits.
BE IT FURTHER RESOLVED, That Plan Commission recommends approval of the road
vacation along Martin Drive as part of the Copper Oaks Final Plat upon the Engineering
Departments supporting recommendation to Council.
BE IT FURTHER RESOLVED, A preservation easement and restrictions will have to be shown
on the final plat before Common Council approvals and the easement will stem from the south
building restriction lines of Lots 6-10 down to the southern border of the plat and along portions
of Outlot 6.
BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers, and payment of
all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments
if applicable.
BE IT FURTHER RESOLVED, That a digital file of this Final Plat shall be submitted to the City
in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
BE IT FURTHER RESOLVED, That the pedestrian easement will be paved and identified.
