PCR2005116AMENDED RESOLUTION #P.C. 116-2005 APPROVAL OF AN ACCESSORY STRUCTURE (CARPORT) FOR THE BALSON PROPERTY LOCATED IN THE NW ¼ OF SECTION 4 (TAX KEY NO. 2174.973 / S64 W18638 TOPAZ DRIVE) WHEREAS, On September 6, 2005 a site plan and building photos were submitted by John Balson to construct an accessory structure (Miscellaneous screening device / carport) for the property located at S64 W18638 Topaz Drive, and WHEREAS, The property is zoned RS-2, Suburban Residence District, and where said accessory structure is a permitted accessory use and subject to Plan Commission review due to the requirements of the General Design Guide regarding miscellaneous screening devices, and WHEREAS, The proposed accessory structure (miscellaneous screen device / carport) will be 12’ x 29’ in size, totaling 348 square feet, and will be located within 2 feet from the existing northern garage attached to the principal dwelling and WHEREAS, The total square footage for accessory structures on this property is limited to the greater of 720 square feet or 60% of the principal dwellings living floor area, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, Currently on the parcel is only the principal dwelling, and WHEREAS, The structure is proposed to be constructed of metal materials with colors to match the principal dwelling siding. THEREFORE BE IT RESOLVED, That the Plan Commission approves an accessory structure (miscellaneous screen device / carport), 348 square feet in area, submitted by John Balson for a property located at S64 W18638 Topaz Drive. BE IT FURTHER RESOLVED, That this is a permanent accessory screening device and must observe all property line setbacks/offsets, however the structure may be located next to the existing garage. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That the roof only will be allowed on structure.
