APPROVAL OF A FOUR (4) LOT CERTIFIED SURVEY MAP AND RECOMMENDATION
TO COUNCIL FOR A REZONING FROM EA EXCLUSIVE AGRICULTURAL TO A
AGRICULTURAL AND RCE COUNTRY ESTATE LOCATED IN THE
SE ¼ OF SECTION 30 (PARKER DRIVE / TAX KEY NO. 2280.999)
WHEREAS, On September 6, 2005 a Certified Survey Map for a four (4) lot land division and a
petition for a rezoning was submitted by Bryon Hrin for a property located in the SE ¼ of Section
30, (Tax Key No. 2280.999 / Parker Drive), and
WHEREAS, The proposed land division would create lots with minimum areas of 2.75 acres, and
WHEREAS, Said property is zoned EA Exclusive Agricultural, requiring a minimum lot size of
35 acres and an average minimum width of 1275 feet and requires a rezoning to A Agricultural
and RCE Country Estate District to permit land divisions with minimum lot sizes of 2.75 acres
and an average minimum widths of 250 feet, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for Agricultural
and Open Lands consistent with the proposed rezoning and land division, and
WHEREAS, Said parcels will be serviced by private sanitary sewerage and water supply
facilities, and
WHEREAS, The Public Works Committee reviewed the CSM at their October 17, 2005 meeting
and recommended the following:
• That the CSM have language on it noting that the roadway is public but will be
maintained privately,
• That the CSM have language on it noting that the roadway will require full public
construction improvements should a future land division occur and that this burden shall
not be binding on the City of Muskego or residents of Lots 1-4,
• That all vehicular access shall occur off of the new private road and not Parker Road,
• That the private driveway be constructed to minor specs as approved by the Engineering
Department and that these standards be completed before the issue of an y building
permit for Lots 1-4,
• That a driveway agreement be recorded for each parcel within the CSM that notes the
maintenance requirements of the driveway for the residents of Lots 1-4,
• That the final CSM and driveway agreement be reviewed by the PW committee before
City signatures on the CSM, and
WHEREAS, Rights of way have been dedicated in accordance with the 2010 Street System Plan.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey
Map being submitted creating four parcels and recommends approval to the Common Council for
a rezoning from EA Exclusive Agricultural to A Agricultural and RCE Country Estate District on
the Hrin property located in the SE ¼ of Section 30, subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers, and payment of
all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding
assessments if applicable.
BE IT FURTHER RESOLVED, Waste disposal system areas must be delineated on the final
CSM before City signatures.
BE IT FURTHER RESOLVED, That the resolution is subject to all Public Works Committee
recommendations being met and that the CSM and driveway agreements be reviewed by the
Public Works Committee prior to City signatures and recording.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in
accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
