PCR2005112RESOLUTION #P.C. 112-2005 APPROVAL OF AN ACCESSORY STRUCTURE FOR THE FROST PROPERTY LOCATED IN THE NW ¼ OF SECTION 12 (TAX KEY NO. 2206.998.023 / S71 W13493 WOODS ROAD) WHEREAS, On August 29, 2005 a site plan and building drawings were submitted by James Frost to construct a 440 square foot accessory structure (20 x 22) on the property located at S71 W13493 Woods Road, and WHEREAS, The property is zoned RS-2 Suburban Residence District, and where said structure is a permitted accessory use and subject to Plan Commission review due to more than one accessory structure on the lot as per design guidelines for residential uses, and WHEREAS, A 24 x 36 accessory garage and the home residence all currently reside on the property, and WHEREAS, The total square footage for accessory structures on this property is limited to 1,350 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, The structure is proposed to be constructed with vinyl siding and an asphalt shingled roof and said proposal does meet the Plan Commission’s standards for administrative approval of residential accessory structures as the siding and roof materials do match the materials used on the primary residence, and WHEREAS, The proposed height will be ten (10) feet tall and this is allowed by right. THEREFORE BE IT RESOLVED, That the Plan Commission approves a 440 square foot accessory structure submitted by James Frost for the property located at S71 W13493 Woods Road. BE IT FURTHER RESOLVED, That the Plan Commission approves of the accessory structure due to no undue harm to the surrounding properties. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
