PCR2005111AMENDED RESOLUTION #P.C.111-2005 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR AUTOZONE AND A RETAIL CONVENEINCE CENTER LOCATED IN THE NE ¼ OF SECTION 17 (JANESVILLE ROAD / TAX KEY NO. 2225.987.001) WHEREAS, On September 6, 2005 plans were submitted by Redmond Commercial Development Co. for a Building, Site and Operation Plan for Autozone and a Retail Convenience Center located in the NE ¼ of Section 17 (Janesville Road / Tax Key No. 2225.987.001), and WHEREAS, Said property is currently zoned B-2 Local Service Center, and said use is a permitted use within this zoning district, and WHEREAS, Said parcels will be serviced by public sewer and water facilities, and WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s Downtown Design Guide and General Design Guide, and WHEREAS, The petitioner requests approval for a 12,921 square foot structure to house an Autozone store and 1 to 4 retail/commercial leased areas, and said structure appears to meet the requirements of the zoning ordinance, and WHEREAS, Said structure is proposed to be built according to the Downtown Design Guide which promotes structures to utilize materials of a residential character and to be harmonious with the natural and built surroundings while avoiding repetition and monotony, and WHEREAS, The Downtown Design Guide requires Four-sided architecture which utilizes similar building materials and design for all sides of a proposed structure, and WHEREAS, Said structure is proposed to be constructed with exterior materials which include Split Face Decorative CMU, Decade 90 Brick, accent brick, a Decorative CMU sill, E.I.F.S Accent Trim, and dimensional asphalt shingles, and WHEREAS, Said structure includes architectural elements such as pillars, alternating rooflines, insulated panels, spandrel glass, aluminum storefronts, and changes in depth (Canopies), and WHEREAS, Colors of the proposed principal structure are shown in the colored rendering as all earth tones with appropriate break-ups in the design that meet the intent of the Downtown Design Guide, and WHEREAS, All Building mechanicals, including HVAC units, are not shown but appear to be screened, and WHEREAS, Access is shown to the site from an entrance along Janesville Road and from two access points along the shared border with Walgreen’s to the east and cross-access easements were previously recorded by CSM for these cross border accesses, and WHEREAS, All access ways are shown in conformity at 24 feet or greater in width, and WHEREAS, 54 parking stalls are shown and is more than sufficient, as parking requirements needed by code would be 1 stall for every 150 square feet of customer floor area and 50% of a new retail building is usually considered customer floor area, and WHEREAS, Cross Access is depicted from the Walgreen’s site and this is consistent with the intent of the Downtown Design Guide, and WHEREAS, Area for a monument sign is depicted on the site plan near the entrance off of Janesville Road, and WHEREAS, The backlit monument sign is to be 12’ 11” in height, 47 square feet in actual signage area, and the proposed signage meets the zoning requirements, and WHEREAS, The petitioners propose to have each commercial entity have their own corporate identities on the monument sign, and WHEREAS, The monument sign will incorporate the materials found on the principal structure and will be amply landscaped as per the Downtown Design Guide, and WHEREAS, The B-2 zoning limits each tenant to 5% of the leased wall area for wall signage and the wall signage is shown on the building elevations for each future tenant including Autozone and the wall signage is proposed to be corporate specific colors, and WHEREAS, The Autozone wall signs are found on the east and north facades of the building and measure 46.75 square feet each, within the 5% requirement for each façade. WHEREAS, Each wall sign and future sign will be a consistent illuminated channel letter, and WHEREAS, A photometric plan and lighting specifics are shown on the submittal and eight 150 watt high pressure sodium decorative tear drop head with decorative dark green cast aluminum pole lights with 6-inch cement bases will be found throughout the parking lot, matching those found at the neighboring Walgreen’s, six 100w high-pressure sodium down lights with clear alzak trim will be found under the canopies above the doorways, five quarter-spherical high pressure sodium wall mounted security lights with emergency lights will be found on the southern façade and the northwest façade, and five quarter-spherical high pressure sodium wall mounted security lights will be found above a few of the backdoors on the western façade, and WHEREAS, The photometric plan shows that the lighting will exceed the City’s requirement of 0.5 foot-candles at the property line in all areas except the western to southwestern property line, and WHEREAS, One of the pole lights on the northwest corner of the development shows excessive foot-candle bleeding on the property adjacent to the west and this property is currently used as residential, and WHEREAS, A landscaping plan has been submitted, and the plan has been reviewed by the City Forester and revisions are necessary, and WHEREAS, A dumpster enclosure is proposed to house all refuse containers located on the southwest portion of the property and is to be made of a cedar board gate and split face CMU block and the enclosure will incorporate colors of the principal structure. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan for Autozone and retail convenience center by Redmond Commercial Development Co. for a property located in the NE ¼ of Section 17 (Janesville Road / Tax Key No. 2225.987.001). BE IT FURTHER RESOLVED, That future tenants will need Plan Department approval for signage and that the Autozone signage is approved along with this BSO submittal. BE IT FURTHER RESOLVED, That Plan Commission will allow the wall and monument signage for the development to utilize corporate colors in the future, as there are limited tenants and it should not affect the overall cohesiveness of the site, although each sign should incorporate the same type of channel lettering or Plan Commission approval will be needed. BE IT FURTHER RESOLVED, Where the foot-candles do exceed the requirements is acceptable by Plan Commission as these areas are the Janesville Road right-of-way (North), Walgreen’s site (East), and a stormwater pond (South), which not negatively affect the area. BE IT FURTHER RESOLVED, That the 0.5 foot-candles requirement must be met in the pole light location on the northwest corner of the development as the neighboring property is residential until the property becomes commercial and that a revised photometric plan will need to be delivered before the issuance of building permits showing this conformance. BE IT FURTHER RESOLVED, That the landscape plan be formally approved by the City Forester before building permits are released, and BE IT FURTHER RESOLVED, Fire Department review will be required and minor changes to the development allowing proper fire access may be needed. BE IT FURTHER RESOLVED, That outdoor sales shall be expressly prohibited on the property; including, but not limited to, vending machines, LP, and palettes of various products (water softener salt, soda, etc.). BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code. BE IT FURTHER RESOLVED, That the concrete base of any light pole be no more than 6” above grade and that any light pole cannot exceed 15-feet in height. BE IT FURTHER RESOLVED, That all mechanicals shall be screened from view. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That no deliveries may occur after 10:00 p.m. or before 6:00 a.m. for the site.
