PCR2005110RESOLUTION #P.C.110-2005 APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR MUSKEGO AREA FAMILY MOOSE LODGE IN THE SW ¼ OF SECTION 18 (TAX KEY NO. 2231.995/ JANESVILLE ROAD) WHEREAS, On September 1, 2005 plans were submitted by Joe Thibedeau for an amendment to a Building, Site and Operation Plan for the Muskego Area Family Moose Lodge located in the SW ¼ of Section 18 (Tax Key No. 2231.995 / Janesville Road), and WHEREAS, Said property is zoned B-2/OHS Local Service Center District with a Highway Service Overlay District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and WHEREAS, Petitioner received approvals as per Resolution #P.C. 077a-2004 to allow a new 3,200 square foot structure, while also updating lighting, landscaping, and parking arrangements on the site, and WHEREAS, The petitioner wishes to alter the approvals from Resolution #P.C. 077a-2004 to allow changes to the parking and lighting arrangements, and WHEREAS, The petitioner wishes to remove the requirement for having curb around the site and to only have the asphalt parking areas instead, and WHEREAS, The petitioner wishes to remove the originally approved pole lights and replace them with five (5) high pressure sodium boxlights, and WHEREAS, Three (3) boxlights will adorn the tower, one will adorn the south elevation, and one will adorn the east elevation, and WHEREAS, A photometric plan shows that the new lighting will not hamper surrounding properties or the roadways. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Muskego Area Family Moose Lodge located in the SW ¼ of Section 18 (Tax Key No. 2231.995 / Janesville Road). BE IT FURTHER RESOLVED, That all previous approvals from Resolution #P.C. 077a- 2004 still apply with the exceptions herein. BE IT FURTHER RESOLVED, That new grading plans will need to be delivered and approved by the Engineering Department prior to new development taking place. BE IT FURTHER RESOLVED, That if grass areas become disturbed by vehicle and pedestrian traffic due to having no curbing on the parking lot that the owners must fix the disturbed areas within 10 days from being notified by the Planning Department. BE IT FURTHER RESOLVED, That the Planning Commission allows the new amendments due to the limited use and rural locations that exist in the area and on the developed site. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
