RESOLUTION #P.C. 108-2005
RECOMMENDATION TO COUNCIL TO REZONE THE MILLER PROPERTY FROM
THE RS-2 SUBURBAN RESIDENCE DISTRICT TO RS-3 SUBURBAN RESIDENCE
DISTRICT LOCATED IN THE SE ¼ OF SECTION 5
(TAX KEY NO. 2180.978 / S69 W19043 HILLENDALE DRIVE)
WHEREAS, On August 19, 2005 a petition for rezoning was submitted by Leonard &
Terry Miller to rezone a property from the RS-2 Suburban Residence District to RS-3
Suburban Residence District, and
WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common
Council on September 27, 2005, and
WHEREAS, The petition would permit sewered residential development where sewered
residential development is currently allowed, and
WHEREAS, The property is currently being used as residential and the rezoning would
allow a greater density residential use in the future, and
WHEREAS, The property is currently served by public sewer and private water, and
WHEREAS, There was a Public Hearing held on September 27,2005 and there were no
comments made regarding this rezoning, and
WHEREAS, The 2010 Comprehensive Plan depicts the property for medium density
single-family development and the rezoning is consistent with this goal.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
approval to the Common Council for the rezoning from the RS-2 Suburban Residence
District to RS-3 Suburban Residence District for the Miller property (Tax Key No.
2180.978 / S679 W19043 Lembezeder Drive).
BE IT FURTHER RESOLVED, That any future land divisions of the lot may require some
or all of the lots to connect to Municipal water.
