PCR2005105RESOLUTION #P.C.105-2005 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR TERRA FIRMA LANDSCAPE INC. IN THE NE ¼ OF SECTION 2 (TAX KEY NOS. 2165.976 & 2165.977/ JANESVILLE ROAD) WHEREAS, On August 23, 2005 plans were submitted by Heather Schuster for an amendment to a Building, Site and Operation Plan for Terra Firma Landscape, Inc. located in the NE ¼ of Section 2 (Tax Key Nos. 2165.976 and 2165.977 / Janesville Road), and WHEREAS, Said property is currently zoned HC-1 Tess Corners Historic District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and WHEREAS, The business has past approvals including Conditional Use Grant #94 which allow the landscape business, equipment associated with the landscape business, and a residential unit on the upper floor of the structure to exist by right on the parcel, and WHEREAS, The Petitioner proposes to modify the current building to restore the old look of the structure by replacing areas that were once garage doors with new aluminum frame windows, and WHEREAS, The Tess Corners Design Guide promotes the restoration of the structures that once existed there, and WHEREAS, The Petitioner also proposes site modifications including the addition of landscaping, material bins, and new parking areas throughout the two properties, and WHEREAS, The landscape plan shows good detail and must be formally approved by the City Forester, and WHEREAS, The newly proposed site modifications are to be asphalted throughout, although brick pavers may be used on the employee parking lot where financially feasible, and WHEREAS, Parking is illustrated as 24 new employee only parking stalls sized at 9’ x 18’ and two new customer parking stalls sized at 10’ x 20’, and WHEREAS, The Tess Corners Design Guide promotes parking to avoid the sea of asphalt syndrome and promotes landscaping to compliment the natural and built environment and the proposal appears to satisfy the design guide, and WHEREAS, Stormwater management is not required as the proposed modifications do not add enough impervious surface areas to require the management, and WHEREAS, Any proposed modifications, such as landscaping or retaining walls, within the public right-of-way, must receive proper approvals from Waukesha County or the City of Muskego Public Works Committee, and WHEREAS, No new lighting is proposed and any new lighting would need approvals for design and light intensity consistency, and WHEREAS, The properties are within Redevelopment District #2 and must be reviewed by the Community Development Authority for any recommendations. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Terra Firma Landscape, Inc. located in the NE ¼ of Section 2 (Tax Key Nos. 2165.976 and 2165.977 / Janesville Road). BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
