PCR2005103RESOLUTION #P.C. 103-2005 APPROVAL OF A YIELD PLAN AND SKETCH CONSERVATION SUBDIVISION AND A RECOMMENDATION TO THE COMMON COUNCIL FOR A REZONING FROM A AGRICULTURAL TO RCE/COPD COUNTRY ESTATE DISTRICT WITH A CONSERVATION PLANNED DEVELOPMENT OVERLAY DISTRICT FOR A PROPERTY LOCATED IN THE SW ¼ OF SECTION 30 (TAX KEY NO. 2279.993 / CROWBAR DRIVE) WHEREAS, On August 17, 2005, a Yield Plan, a Sketch Conservation Subdivision, and a rezoning request was submitted by the Loughneys for a property located in the SW ¼ of Section 30 (Tax key No. 2279.993 / Crowbar Drive), and WHEREAS, The Yield Plan consists of approximately 23.91 acres, proposes SEVEN (7) residential parcels, and WHEREAS, The sketch Conservation Subdivision consists of approximately 23.91 acres, and proposes TEN (10) residential parcels, and provides for common stormwater management and open space outlots totaling approximately 52.5% of the land area, and the COPD regulations would permit 3 “bonus” parcels in lieu of meeting certain code provisions, and along with the 3 bonus lots (Lots 5, 8, and 9), the conceptual plan totals approximately 65.2% open space, and WHEREAS, Said property is zoned A Agricultural District, and a rezoning to RCE / COPD Rural Country Estate District with a Conservation Planned Development Overlay District is requested as part of the conservation development, and WHEREAS, Zoning of RCE/COPD requires lots to be a maximum of 60,000 square feet and a maximum of 150’ in width and all parcels conform to these requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area for agriculture and open lands at a density not to exceed .4 dwelling units per acre, and the Yield Plan illustrates a maximum density of 0.3 dwelling units per acre and sketch Conservation Subdivision illustrates a maximum density of 0.4 dwelling units per acre consistent with the plan, and WHEREAS, Said parcels will be serviced by private sewer and water service, and WHEREAS, The 2010 Street System Plan depicts Crowbar Drive to have an 80 foot wide ultimate width, and the future preliminary plat will need dedications, and WHEREAS, Upland woodlands exist on the property and are depicted on the sketch Conservation Subdivision to be preserved as common open space, and the Conservation Plan depicts a portion of these woodlands as a medium acquisition priority, and WHEREAS, The plat is required to provide on-site stormwater management as required by Chapter 34, and the sketch Conservation Subdivision accommodates this requirement. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a yield plan, a sketch Conservation Subdivision, and a Recommendation to the Common Council for a rezoning from A Agricultural to RCE/COPD Rural Country Estate District with a Conservation Planned Development Overlay District submitted by the Loughneys for a property located in the SW ¼ of Section 30 (Tax key No. 2279.993 / Crowbar Drive), and will be receptive to the submittal of a preliminary plat of the Conservation Subdivision. BE IT FURTHER RESOLVED, That a maximum 3 bonus residential parcels are permitted subject to Plan Commission and Common Council findings that the Final Plat meets the requirements for the receipt of said bonus parcels. BE IT FURTHER RESOLVED, That the Conservation Commission shall review the conceptual plat before the time of preliminary plat. BE IT FURTHER RESOLVED, That the common open space areas shall be subject to a Management Plan which shall be executed concurrent with the Final Plat.
