PCR2005102RESOLUTION #P.C. 102-2005 APPROVAL OF A FINAL PLAT FOR THE WEATHERWOOD COURTS SUBDIVISION LOCATED IN THE NE ¼ OF SECTION 25 (RYAN ROAD / TAX KEY NO. 2257.999) WHEREAS, On July 25, 2005 a final plat was submitted by North Cape LLC for the Weatherwood Courts Subdivision located in the NE ¼ of Section 25, and WHEREAS, Said plat proposes 20 single-family lots and one (1) outlot, and WHEREAS, Said property is zoned RS-3 Suburban Residence District which requires a minimum lot size of 15,000 square feet and minimum width of 100 feet and said lots meet these zoning requirements, and WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission's previously approved Preliminary Plat, under Resolution #P.C. 036-2005, and WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Plan, the Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by municipal sewer and water, and WHEREAS, Outlot 1 will accommodate stormwater management, and THEREFORE BE IT RESOLVED, That the Plan Commission recommends, approval to the Common Council of a 20 lot Final Plat for the Weatherwood Courts Subdivision, located in the NE ¼ of Section 25, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That Street Tree and Landscape Plans are required to be submitted and approved by the Plan Commission prior to release of Building Permits. BE IT FURTHER RESOLVED, That the 40 foot setback line shall be shown on all lots abutting a public right-of-way including Ryan Road and North Cape Road to ensure future buyer notification of the lot restrictions. BE IT FURTHER RESOLVED, That this approval is subject to Developer’s Agreements and a Letter of Credit being approved by the City’s Finance Committee prior to Council approvals. BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution #196-2002.
