RECOMMENDATION TO COUNCIL TO REZONE THE BORCHARDT PROPERTY
FROM RS-2 SUBURBAN RESIDENCE DISTRICT, RSA ATTACHED SINGLE-
FAMILY DISTRICT, AND RSA/OIP ATTACHED SINGLE-FAMILY DISTRICT
WITH AN INSTITUTION AND PUBLIC SERVICE OVERLAY DISTRICT TO RS-2
SUBURBAN RESIDENCE DISTRICT, RSA ATTACHED SINGLE-FAMILY
DISTRICT, AND RSA/OIP ATTACHED SINGLE-FAMILY DISTRICT WITH AN
INSTITUTION AND PUBLIC SERVICE OVERLAY DISTRICT LOCATED IN THE
SE ¼ AND NE ¼ OF SECTION 3 (TAX KEY NO. 2169.987 / MARTIN DRIVE).
WHEREAS, On June 29, 2005 a petition for rezoning was submitted by Wayne
Borchardt to rezone a property from RS-2 Suburban Residence District, RSA Attached
Single-Family District, and RSA/OIP Attached Single-Family District with a an
Institution and Public Service Overlay District to RS-2 Suburban Residence District,
RSA Attached Single-Family District, and RSA/OIP Attached Single-Family District
with a an Institution and Public Service Overlay District located in the SE ¼ and NE ¼ of
Section 3 (Tax Key No. 2169.987 / Martin Drive), and
WHEREAS, A Public Hearing for the rezoning was heard before the Common Council
on August 9, 2005, and
WHEREAS, The zoning lines are currently in place on the property as per the City
rezoning of the Moorland Corridor area in early 2004 and the petitioner has now
submitted a preliminary plat that relocates the zoning lines in the same general area, and
WHEREAS, The petition would permit sewered residential development where sewered
residential development is currently allowed, and
WHEREAS, The property is currently being used as agriculture and the rezoning would
allow the a greater density residential use in the future, and
WHEREAS, The property is currently served by public sewer and water and these
services will continue, and
WHEREAS, The 2010 Comprehensive Plan depicts the property for medium density
single-family development and Government and Institutional development and the
rezoning is consistent with this goal.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
approval to the Common Council for the rezoning from the RS-2 Suburban Residence
District, RSA Attached Single-Family District, and RSA/OIP Attached Single-Family
District with a an Institution and Public Service Overlay District to RS-2 Suburban
Residence District, RSA Attached Single-Family District, and RSA/OIP Attached Single-
Family District with a an Institution and Public Service Overlay District for the
Borchardt property located in the SE ¼ and NE ¼ of Section 3 (Tax Key No. 2169.987 /
Martin Drive).
BE IT FURTHER RESOLVED, That the new zoning line relocation on the Borchardt
property match the property lines for the different zoning categories found on the
Oakridge Glen Preliminary Plat as per Resolution #P.C. 085-2005.
BE IT FURTHER RESOLVED, That the Planning Commission approves of the
rezoning realignment as it still meets the intent of the original Moorland corridor
rezoning as an area of residential still separates the existing Chamberlain Hill subdivision
from the multi-family zoning and the multi-family zoning still is shown as an adequate
buffer to the future Business Park on Moorland Road.
