PCR2005093RESOLUTION #P.C. 093-2005 APPROVAL OF AN ACCESSORY STRUCTURE FOR THE YETS PROPERTY LOCATED IN THE SW ¼ OF SECTION 30 (TAX KEY NO. 2279.994 / S102 W21742 KELSEY DRIVE) WHEREAS, On July 20, 2005 a site plan and building drawings were submitted by Sheri Yets to construct a 1,900 square foot accessory structure (25 x 39 with two levels) on the property located at S102 W21742 Kelsey Drive, and WHEREAS, The property is zoned A, Agricultural District, and where said structure is a permitted accessory use and subject to Plan Commission review due to more than one accessory structure on the lot as per design guidelines for residential uses, and WHEREAS, A 20 x 20 garage (To be removed for the new garage structure), Garden House 11 x 12, Storage Shed 10 x 14, Butcher Building 16 x 16, Goat Building 6 x 10, Chicken Building 6 x 8, and the home residence all currently reside on the property, and WHEREAS, The total square footage for accessory structures on this property is limited to 4, 809 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, The structure is proposed to be constructed with dark brown trim, sandstone vinyl siding, and a white asphalt shingled roof and said proposal does meet the Plan Commission’s standards for administrative approval of residential accessory structures as the siding and roof materials do match the materials used on the primary residence, and WHEREAS, The property is rural in character and agricultural uses are present in this general area, and WHEREAS, The proposed height will be 18.5 feet tall and this is allowed due to the large parcel size. THEREFORE BE IT RESOLVED, That the Plan Commission approves a 1,900 square foot accessory structure submitted by Sheri Yets for the property located at S102 W21742 Kelsey Drive. BE IT FURTHER RESOLVED, That the Plan Commission approves of the accessory structure due to no undue harm to the surrounding properties, the materials matching the other buildings, and the location and use of the property. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
