PCR2005090RESOLUTION #P.C.090-2005 APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR PREFERRED FITNESS LOCATED IN THE JANESVILLE ROAD RETAIL CENTER INTHE SW ¼ OF SECTION 10 (TAX KEY NO. 2199.999.022 / JANESVILLE ROAD) WHEREAS, On July 18, 2005 plans were submitted by Laura Pipp for an amendment to a Building, Site and Operation Plan for Preferred Fitness that will be located in a leased area (Former Walgreens site) in the Janesville Road Retail Center property located in the SW ¼ of Section 10 (Tax Key No. 2199.999.022 / Janesville Road), and WHEREAS, Said property is zoned B-2/OWP Local Service Center District with a Wellhead Protection Overlay District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and WHEREAS, Petitioner requests to change the originally approved Building Site and Operation Plan to change the storefront of the former Walgreens leased area to add full length windows and additional signage to the storefront, and WHEREAS, The additional windows will be 1” tempered glass and will increase the visibility of the building, and WHEREAS, The signage proposed is limited to 5% of the leased elevation area and the proposed signage totals 94 square feet equaling 5% of the leased elevation area (Elevation area = Approx. 2,068 square feet), and said sign meets the requirements for the B-2 zoning district, and WHEREAS, The signage proposed will be internally laminate red channel lettering and is consistent with the other signage on the retail center, and WHEREAS, The property is within the Redevelopment District #2 although no Community Development Review is needed at this time due to the un-substantial changes that are present. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for Preferred Fitness that will be located in a leased area (Former Walgreens site) in the Janesville Road Retail Center property located in the SW ¼ of Section 10 (Tax Key No. 2199.999.022 / Janesville Road). BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
