APPROVAL OF FINAL PLAT FOR THE NURSERY SUBDIVISION
LOCATED IN THE SE ¼ OF SECTION 12
(MC SHANE DRIVE / TAX KEY NO. 2208.998)
WHEREAS, On August 24, 2005 a Final Plat of The Nursery Subdivision was submitted by
James Schilling for the property located in the SE ¼ of Section 12, and
WHEREAS, Said plat proposes seven (7) lots consisting of six (6) single-family lots ranging
from 20,005 square feet to 25,490 square feet, and one (1) outlot, and
WHEREAS, Said property is zoned RS-2 Suburban Residence District, which require a
minimum lot size of 20,000 square feet and minimum width of 110 feet for sewered lots, and
said lots meet these zoning requirements, and
WHEREAS, Lot 6 contains a “Wetland Easement” that covers the wetlands plus a ten (10)
foot buffer around the wetlands for wetland protection, and
WHEREAS, The plat contains a note that there will be a split rail fence placed upon Lot 6 that
will need to be maintained by the owner of said lot, and
WHEREAS, The split rail fence along the wetland area will further ensure that the wetlands
will remain untouched, and
WHEREAS, A letter has been submitted by the land owner to the east stating that they have
no objections with the right-of-way being placed along their lot line, and
WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission's previously
approved Preliminary Plat, under Resolution #P.C. 054-2005, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for medium density residential
development, and this proposal is consistent with this goal, and
WHEREAS, The Plan Commission has found that the plat is consistent with the adopted
Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street
System Plan, and
WHEREAS, Said parcels will be serviced by City sewer and private wells.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the
Common Council of a Final Plat for The Nursery Subdivision, located in the SE ¼ of Section
12 (Tax Key No. 2208.998 / Mc Shane Drive).
BE IT FURTHER RESOLVED, That Street Tree and Landscape Plans shall be approved by
the City Forester prior to the issuance of any building permits.
BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers, and payment
of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding
assessments if applicable.
BE IT FURTHER RESOLVED, That a digital file of this Final Plat shall be submitted to the City
in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
