APPROVAL OF A PRELIMINARY PLAT FOR RUSTIC TRAILS SUBDIVISION LOCATED
IN THE NW ¼ OF SECTION 13 (FIELD DRIVE / TAX KEY NO. 2188.999)
WHEREAS, On January 11, 2006 a preliminary plat was submitted by Field Drive LLC for the Rustic
Trails Subdivision located in the NW ¼ of Section 13 (Field Drive / Tax Key No. 2188.999), and
WHEREAS, Said plat proposes five (5) single-family lots ranging from approximately 2.75 to 4.78 acres
and one (1) outlot for stormwater purposes, and
WHEREAS, Said property is zoned RCE Country Estate District requiring lots of 2.75 acres in size and at
least 250 feet in width and said parcels meet these requirements, and
WHEREAS, Said property is shown on the 2010 Land Use Plan as Rural Density Residential consistent
with the RCE zoning district permitting parcels of 0.4 units an acre, and the proposed plat meets these
requirements, and
WHEREAS, Medium management areas are found on the plat within the City’s Conservation Plan and the
City Conservation Commission previously recommended that these areas be saved and dedicated to the
City, and
WHEREAS, It appears that the roadway and some grading may destroy trees on the platted area and a tree
survey may be required, and
WHEREAS, The City’s Planning Commission defeated Resolution #P.C. 054-2005 seeing that the parcel
should be divided per the existing RCE zoning, and
WHEREAS, The environmental areas will not be dedicated to the City but may need to be incorporated
into preservation easements to assure their future protection, and
WHEREAS, Larger setback buffers for the existing wetlands may be required as per the City’s Stormwater
Ordinance, and
WHEREAS, The Lot 3 may require additional access easements, and
WHEREAS, The plat is consistent with the adopted 2003-2007 Park and Open Space Plan and the 2010
Street System Plan, and
WHEREAS, Said parcels will be serviced by private sewer and water, and
WHEREAS, Stormwater management will be accommodated on-site within Outlot 1.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common
Council of a five (5) lot Preliminary Plat for Rustic Trails Subdivision located in the NW ¼ of Section 13
and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as
identified by the City Planning Department and City Engineers, and payment of all applicable fees in
Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That all the wetlands, along with a 50-foot buffer, shall be included in
preservation easements. This is due to the City’s Chapter 34 Stormwater Ordinances showing that the
wetlands on the plat are highly susceptible wetlands, which require 50-foot setbacks. The developers
should deliver evidence that the wetlands are less susceptible as determined by the DNR if they would like
reduced setbacks from the wetlands and preservation easements.
BE IT FURTHER RESOLVED, That a tree survey will be needed to be delivered to the planning
Department prior to Final Plat approvals showing the trees to be destroyed that are 6” calipers or larger.
The developer is responsible to add one tree for every one removed and this addition of trees must be
found on the upcoming landscaping plan by final plat time.
BE IT FURTHER RESOLVED, That Lot 2 show a driveway access easement running around the wetland
preservation easements back to Lot 3 for proper Lot 3 access.
BE IT FURTHER RESOLVED, A five-foot street tree easement will be needed surrounding the Trails
Court right-of-way and a landscaping plan approval will be needed at the time of a Final Plat.
BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance
with Common Council Ordinance No. 1118 and Resolution 196-2002.
