PCR2005080aAMENDED TWICE AMENDMED RESOLUTION #P.C. 080-2005 APPROVAL OF BUILDING SITE AND OPERATION PLAN AMENDMENT AND CONDITIONAL USE GRANT FOR BURBACK BUILDERS LOCATED IN THE NW ¼ OF SECTION 16 (W185 S8095 RACINE AVE. / TAX KEY NO. 2221.016.001) WHEREAS, Plans were submitted on June 6, 2005 by Burback Builders LLC for a Building, Site and Operation Plan Amendment and Conditional Use Grant for mini-warehouse storage at the property located in the Muskego Industrial Park in the NW ¼ of Section 16 (W185 S8095 Racine Avenue / Tax Key No. 2221.016.001), and WHEREAS, New elevation drawings of the new storage buildings were submitted on July 26, 2005 displaying a stone beltline matching the principal structure on the lot, and WHEREAS, Said property is currently zoned I-1 Industrial Park District, and said use is a permitted use with the approval of a conditional use grant for mini-warehouse storage, and WHEREAS, The proposal appears to conform to the bulk requirements of the zoning district, and WHEREAS, A conditional use grant has been applied for the use of mini-warehouse storage units within the I-1 Industrial Park zoning district and a public hearing was held before the Planning Commission on July 19, 2005, and WHEREAS, The petitioner is proposing to construct two mini-warehouse storage buildings consisting of a 4,000 square-foot building in the northwest portion of the property and an 8,000 square-foot building in the southwest portion of the property, and WHEREAS, The 4,000 square-foot building will contain 10 units measuring 20’ x 20’ and they will be climate controlled, and WHEREAS, The 8,000 square-foot building will contain 36 units measuring 10’ x 20’ and 8 units measuring 10’ x 10’ (44 total units), and WHEREAS, Building materials and colors used on the proposed structure will match the existing principal structure and will include weatherwood colored dimensional asphalt shingles, beige colored Miratec corners and wraps, taupe colored hardi-plank siding, and a stone beltline where feasible, and WHEREAS, The new buildings are not shown to have any masonry product on their exterior, and WHEREAS, The new buildings do not meet the 50% masonry requirement for a commercial structure per the City’s General Design Guide, and WHEREAS, Parking is illustrated as 5 parking stalls for public use and 5 stalls for employee use and the public stalls appear to be under the 10’ x 20’ requirement, and WHEREAS, One (1) space of parking is needed for every 2 employees in an industrial use and the parking depicted allows for this plus additional spaces for customers, and WHEREAS, No additional lighting is shown on the new plans and any new lighting would need Plan Commission approval, and WHEREAS, No area is designated for refuse/recycling and Plan Commission approval would be needed if an enclosure is sought, and WHEREAS, A monument sign location is shown although no specific signage is proposed at this time and Plan Commission and/or staff approval may be needed when signage is requested, and WHEREAS, A landscape plan has been approved as part of the original BSO submittal and no new changes are proposed at this time, and WHEREAS, An existing chain link fence exists around the north, west, and south sides of the property and the previous BSO approved a new wood plank fence to be located facing the Racine Avenue right-of-way on the northern portion of the office building and a decorative iron gate with an auto operated keypad is to be located on the south portion of the office building, and WHEREAS, The existing chain link fence is in poor condition and in need of repair in some locations, and WHEREAS, Access is provided to the site with one entrance off of Racine Avenue that is a concrete surfaced drive and the current access is sufficient for the site, and WHEREAS, Stormwater management may need to occur if more than half an acre of impervious surfaces are added and may have to be located on the property and will have to be approved by the Engineering Department before building permits will be issued. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan Amendment and Conditional Use Grant for Burback Builders for mini-warehouse storage units at the property located in the Muskego Industrial Park in the NW ¼ of Section 16 (W185 S8095 Racine Avenue / Tax Key No. 2221.016.001). BE IT FURTHER RESOLVED, That the existing accessory structure should be modified to match the existing principal structure and proposed accessory buildings on the site to ensure cohesiveness of the site. BE IT FURTHER RESOLVED, That the existing accessory structure and the new storage buildings do not need to have any masonry product on their facades due to the location behind the principal structure and due to the minimal façade area between the overhead doors. BE IT FURTHER RESOLVED, That the existing chain link fence must be replaced or repaired to look presentable in all locations. BE IT FURTHER RESOLVED, The need for stormwater management for the current site will be determined by the Engineering Department at the time of building permits. BE IT FURTHER RESOLVED, That if an outdoor refuse facility is sought it will need to have location and building elevations approved by the Planning Department and/or Plan Commission. BE IT FURTHER RESOLVED, That no mechanicals are shown to adorn the roof and if any are required they must be screened from view and colored to match the principal structure. BE IT FURTHER RESOLVED, That the site layout is subject to review by the Fire Department. BE IT FURTHER RESOLVED, That a yearly review be held no later than the second meeting in March of every calendar year. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That the site will be asphalted rather than gravel.
