PCR2005079RESOLUTION #P.C. 079-2005 RECOMMENDATION TO COUNCIL FOR A REZONING FROM A AGRICULTURAL TO B- 2 LOCAL SERVICE CENTER DISTRICT AND FOR A 2010 PLAN AMENDMENT FROM LANDFILL AND EXTRACTIVE TO COMMERCIAL FOR THE SCHILL PROPERTY LOCATED IN THE SE ¼ OF SECTION 36 (124th STREET / TAX KEY NO. 2304.996) WHEREAS, On May 24, 2005 a petition for a rezoning was submitted by Al and Gwen Schill for a property located in the SE ¼ of Section 36, (Tax Key No. 2304.996 / 124th Street), and WHEREAS, Said property is zoned A Agricultural and a rezoning request to B-2 Local Service Center is sought to allow commercial uses on the property, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for Landfill and Extractive requires a 2010 Plan Amendment to Commercial if a commercial zoning district is allowed, and WHEREAS, The previous use of the property was a legal non-conforming tavern and that use has discontinued for over a 12 month period and a rezoning is needed to allow commercial uses as conforming again, and WHEREAS, The B-2 zoning district allows a variety of commercial uses by right including retail stores, customer service establishments, Business, professional, public service, banking and savings and loan offices, restaurants, taverns and other commercial entertainment facilities, laundromats, coin operated dry cleaning establishments and laundry or dry cleaning pick-up stations, dental and medical clinics, commercial studios, display galleries, training schools, Public utility offices and installations, and WHEREAS, Said parcels will be serviced by private sanitary sewerage and water supply facilities. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council for a rezoning from A Agricultural District to B-2 Local Service Center and a 2010 Plan Amendment from Landfill and Extractive to Commercial on the Schill property located in the SE ¼ of Section 36.
