APPROVAL OF A BUILDING SITE AND OPERATION PLAN
FOR M & I BANK LOCATED IN THE SW ¼ OF SECTION 2
(SW CORNER OF JANESVILLE AND MOORLAND ROADS / TAX KEY NO. 2167.995.015)
WHEREAS, On May 3, 2005 plans were submitted by The Zimmerman Design Group for a
Building, Site and Operation Plan for M & I Bank located in the SW ¼ of Section 2, and
WHEREAS, Said property is currently zoned B-3/OPD General Business District with a Planned
Development Overlay District and said use is a permitted use, and
WHEREAS, Said parcel will be serviced by public sewer and water facilities, and
WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s
Moorland South Design Guide, and
WHEREAS, The petitioner requests approval for a 4,640 square foot bank on the southwest
corner of Janesville Road and Moorland Road, and said structure appears to meet the
requirements of the zoning ordinance in accords to the setbacks, offsets, open space, and floor
area ratios of the site, and
WHEREAS, The request does not incorporate additional measures usually requested under the
OPD Planned Development zoning and no substantial change hearing is needed, and
WHEREAS, The height of the structure is limited to 30 feet by the current zoning and the
structure meets this requirement with the exception of the tower, however tower element heights
exceeding 30 feet can approved by Plan Commission as per ordinance, and
WHEREAS, The Moorland South Design Guide promotes structures to utilize Craftsman or
Prairie Style influences and the proposed appears to meet the intent of the guide, and
WHEREAS, Said structure is proposed to be constructed with exterior materials which include
limestone panels, limestone stone caps, brick soldier courses, face brick, and dimensional
asphalt shingles, and
WHEREAS, Said structures include architectural elements such as large storefront windows
along the right-of-way facing elevations and a tower and drive-up element add additional
character to the building, and all the elements appear to meet the intent of the Moorland South
Design Guide, and
WHEREAS, The colored rendering shows earth tones that will compliment each other, consistent
with the Moorland South Design Guide, and
WHEREAS, All Building mechanicals, including HVAC units, are not shown but will be screened,
and
WHEREAS, 26 parking stalls are shown with two being handicap, and said parking stalls meet
the requirements for the new structure proposed of at least 1 stall per 200 square feet of
customer floor area, and
WHEREAS, The parking lot will be curbed throughout and the parking stalls all are shown as 20
feet by 10 feet, and
WHEREAS, Pedestrian access is depicted to be connected to the existing recreation trail along
Moorland Road and this element is promoted in the Moorland South Design Guide, and
WHEREAS, Vehicular access is depicted to be utilized off of Princeton Drive, and
WHEREAS, The Moorland South Design Guide promotes cross-access between adjoining
properties and no cross-access is shown on the western border of the site, and
WHEREAS, Signage is depicted as two 36 square foot signs along the tower faces on the
eastern and northern elevations of the structure and said signs appear to be in unity with the
design of the proposed structure, and
WHEREAS, Lighting specifics is part of the BSO and a directive of the Moorland South Design
Guide, and the plan shows use of eleven 189 watt pole lights that will be high pressure sodium
zero-degree cutoff fixtures not exceeding 15 feet in height and having a concrete base of no
more than 6 inches above grade, and said lighting meets the intent of the Moorland South Design
Guide, and
WHEREAS, A photometric plan is part of the BSO and shows over 0.5 footcandles on the south
property line (Entrance), and the Moorland South Design Guide does not permit this, however
increased lighting at property lines of entrances and shared commercial uses can be beneficial,
and
WHEREAS, A landscaping plan has been submitted, and the plans have been reviewed by the
City Forester, and
WHEREAS, A Grading and Erosion Control plan accompanies the submittal and will be approved
by the Building and Engineering Department at the time of building permits, and
WHEREAS, Stormwater will be utilized off-site at an existing pond that is sufficient for the
development, and
WHEREAS, A dumpster enclosure is proposed to house all refuse containers, and said enclosure
is proposed to be constructed with materials and colors compatible with the design of the building
and will be attached to the west façade of the structure.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan by The Zimmerman Design Group for M & I Bank located in the SW ¼ of Section
2.
BE IT FURTHER RESOLVED, That the height of the tower exceeds the zoning ordinance by two
feet and Plan Commission may allow such a variance to the height ordinance for elements such
as towers and the Plan Commission finds that this variance is acceptable and will not harm the
site or surrounding properties.
BE IT FURTHER RESOLVED, That the landscape plan shall be revised and approved by the City
Forester before permits are released.
BE IT FURTHER RESOLVED, That evidence of the recording of a cross access easement be
submitted to show cross access on the western property line for future cross-access to the
adjoining property before the issuance of building permits.
BE IT FURTHER RESOLVED, That the handicap stall signs should be affixed to the curb area in
front of the parking stall and not placed on a concrete movable base.
BE IT FURTHER RESOLVED, That the concrete base of any light pole be no more than 6” above
grade and that any light pole cannot exceed 15-feet in height.
BE IT FURTHER RESOLVED, That the photometric plan appears to exceed the maximum intent
of the design guide, however this appears to improve the safety of the property as it is exceeded
at the entrance to the site.
BE IT FURTHER RESOLVED, That the pathway extending to the recreation trail along Moorland
Road incorporate all necessary ADA regulations and that if a railing is needed it must mimic
those found on the trail access found in the neighboring Jetzfuel site (SE corner of Janesville and
Moorland Roads).
BE IT FURTHER RESOLVED, That a fence will be needed along any retaining wall exceeding 4
feet in height as per the Engineering Department and this fence should be a black aluminum
ornamental fence if needed.
BE IT FURTHER RESOLVED, That all roof top mechanicals shall be screened from view.
BE IT FURTHER RESOLVED, That any additional signage will require Plan Department
approval.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping and/or asphalting, a bond, or cashiers check equal to twice the value of said costs
must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
