APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT
FOR RELEASE THE HOUNDS DOGGY DAY CARE LOCATED IN THE NW ¼ OF SECTION 16
(S81 W18460 GEMINI DRIVE / TAX KEY NO. 2222.984.003)
WHEREAS, Plans were submitted on May 3, 2005 by 3Sisters4, LLC for a Building, Site and
Operation Plan and Conditional Use Grant for Release the Hounds Doggy Day Care at the
property located in the Muskego Industrial Park in the NW ¼ of Section 16 (S81 W18460 Gemini
Drive / Tax Key No. 2222.984.003), and
WHEREAS, Said property is currently zoned I-1 Industrial Park District, and said use is a
permitted use with the approval of a conditional use grant for animal kenneling allowance, and
WHEREAS, The proposal appears to conform to the bulk requirements of the zoning district, and
WHEREAS, A conditional use grant has been applied for the use of animal kenneling within the I-
1 Industrial Park zoning district and a public hearing was heard before the Planning Commission
on June 7, 2005, and
WHEREAS, The petitioner is proposing to open a doggy day care providing services to include:
Spacious indoor/outdoor play areas, individual crates for dogs, variety of toys and equipment for
dog use, in-house services for dog bathing, grooming, etc., retail area for dog foods and
accessories, and overnight/weekend stay accommodations (Kenneling), and
WHEREAS, The petitioners are to utilize approximately 5,000 square feet of leased space in the
southern end of the currently vacant structure on the corner of Gemini Drive and Racine Avenue,
and
WHEREAS, The property currently consists of a vacant industrial metal sided structure that has
dilapidated ungroomed landscaping, unenclosed dumpsters, and miscellaneous debris found
around the site, and
WHEREAS, The 5,000 square feet of leased space is to be remodeled to fit the petitioners
business needs while the rest of the structure will be vacant and may be leased out as a separate
business in the future, and
WHEREAS, The only exterior modifications to the property are to add a 35 x 27 foot chain link
fence with slats to match the building in the area on the southwest corner of the existing
structure, and
WHEREAS, The fenced in area will be for outdoor exercise for the dogs, and
WHEREAS, The fenced in area will remove four of the existing parking stalls, although it will not
hamper the stalls on the extreme southern portion of the parking lot or the access to those
southern stalls.
WHEREAS, The front entrance to the business will be from an existing doorway on the southern
façade of the structure, and
WHEREAS, Ample parking exists for employees (2 at start-up) and for customers consisting of
38 stalls found throughout site after the four are removed for the fenced area, and
WHEREAS, No signage or new lighting is proposed for the development, and all signage and/or
lighting must be approved by staff or, where complications exist, Plan Commission prior to
installation, and
WHEREAS, The adopted Conservation Plan does not outline the area for acquisition or
management initiatives, and
WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not propose acquisitions
in the area, and
WHEREAS, The proposal is consistent with the 2010 Street System Plan, and
WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and
WHEREAS, The property is subject to Chapter 34 of the Municipal Code, and new stormwater
management is not needed as no new impervious surfaces are being added to the existing
industrial site.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan and Conditional Use Grant for Release the Hounds Doggy Day Care at the
property located in the Muskego Industrial Park in the NW ¼ of Section 16 (S81 W18460 Gemini
Drive / Tax Key No. 2222.984.003).
BE IT FURTHER RESOLVED, That the large refuse container must be removed by the time the
business has occupancy, unless it is to be used for modifications to the rest of the building, in
which case it should be stored in an area as to not cause a safety concern with
outgoing/incoming traffic to the doggy day care.
BE IT FURTHER RESOLVED, That the small refuse container (Currently stored at the south end
of the property) must have a defined enclosure. and the type and placement should be delivered
to the Planning Department as part of the building permits (A cedar fenced enclosure is
recommended).
BE IT FURTHER RESOLVED, That the landscaping on the entire property must be cleaned up
prior to occupancy and all miscellaneous debris on the site must be kept clean in the future.
BE IT FURTHER RESOLVED, That the Plan Commission recommends to the property owner to
have the building modified to reflect modern building design (50% masonry) when the building is
leased out in full as the building is on a prime highway in Muskego and updates are necessary if
possible.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
BE IT FURTHER RESOLVED, That a yearly review be held no later than the second
meeting in March of every calendar year.
BE IT FURTHER RESOLVED, That a maximum of forty (40) dogs be allowed on the
premises at any one time.
