PCR2005066RESOLUTION #P.C. 066-2005 APPROVAL OF A SECOND ACCESSORY STRUCTURE FOR THE MARTIN PROPERTY LOCATED IN THE NE ¼ OF SECTION 2 (TAX KEY NO. 2165.990 / W164 S6503 TESS CORNERS DRIVE) WHEREAS, On April 11, 2005 a site plan and building drawings were submitted by Dan Martin to construct a second accessory structure for the property located at W164 S6503 Tess Corners Drive, and WHEREAS, The property is zoned RS-1, Suburban Residence District, and where said accessory structure is a permitted accessory use and subject to Plan Commission review due to the existence of another accessory structure per the General Design Guide requirements, and WHEREAS, The proposed accessory structure will be 24’ x 48’ in size, totaling 1,152 square feet, and WHEREAS, The total square footage for accessory structures on this property is limited to 1,683 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, There is an existing 320 square-foot outbuilding currently on the parcel that will remain, and WHEREAS, There is an existing 637 square-foot outbuilding currently on the parcel that will be razed, and WHEREAS, The structure is proposed to be constructed of residential materials that will be off-white in color to match the existing house color, and WHEREAS, The main purpose of the accessory structure is to enclose all of the outdoor storage that has been stored in the yard in the past. THEREFORE BE IT RESOLVED, That the Plan Commission approves a second accessory structure submitted by Dan Martin for the property located at W164 S6503 Tess Corners Drive. BE IT FURTHER RESOLVED, That all of the outdoor storage in the yard must be relocated and enclosed within the new accessory structure once occupancy is given. BE IT FURTHER RESOLVED, The 637 square foot accessory structure that is on the property must be completely removed/razed within thirty (30) days of final occupancy of the new accessory structure. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
