PCR2005065AMENDED RESOLUTION #P.C. 065-2005 RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT FOR THE NURSERY SUBDIVISION LOCATED IN THE SW ¼ OF SECTION 12 (MCSHANE DRIVE / TAX KEY NO. 2208.998) WHEREAS, On May 23, 2005 a preliminary plat was submitted by JS Development LLC for The Nursery Subdivision located in the SW ¼ of Section 12, and WHEREAS, Said plat proposes six (6) single-family lots ranging from 20,005 square feet to 25,490 square feet and one (1) outlot for stormwater management purposes, and WHEREAS, Said property is zoned RS-2 Suburban Residence District, which require a minimum lot size of 20,000 square feet and minimum width of 110 feet for sewered lots, and said lots meet these zoning requirements, and WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Plan, the Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by public sanitary sewer and individual private wells, and WHEREAS, Lot 6 contains a “Wetland Easement” that covers the wetlands plus a ten (10) foot buffer around the wetlands for wetland protection, and WHEREAS, Stormwater management will be accommodated on-site and final determinations will be made by the time of Final Plat. THEREFORE BE IT RESOLVED, That the Plan Commission recommends, approval to the Common Council of a six (6) lot Preliminary Plat for The Nursery Subdivision, located in the SW ¼ of Section 12 and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That all final easement and stormwater management concerns must be addressed by the time of Final Plat. BE IT FURTHER RESOLVED, That a note shall be placed on the Final Plat stating that no vehicular access off of McShane Drive to Lot #1. BE IT FURTHER RESOLVED, That a letter from the abutting land owner to the east will need to be submitted prior to Final Plat approval stating no objections to the right-of-way along their property line. BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002. BE IT FURTHER RESOLVED, That the trees on Lot 6 shall be surveyed in on the Final Plat and the wetland easement be reconfigured to include the tree line to create a defined line of non- encroachment to the wetlands and notations regarding Lot 6 may be needed on the plat.
