PCR2005064AMENDED RESOLUTION #P.C.064-2005 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR ROBERT SINDIC IN THE SW ¼ OF SECTION 9 AND THE NW ¼ of SECTION 16 (TAX KEY NO. 2195.981 / S78 W18755 JANESVILLE ROAD) WHEREAS, On April 11, 2005 plans were submitted by Robert Sindic for an amendment to a Building, Site and Operation Plan for a property located in the SW ¼ of Section 9 and the NW ¼ of Section 16 (Tax Key No. 2195.981 / S78 W18755 Janesville Road), and WHEREAS, Said property is zoned B-4 Highway Business District, and said use is a permitted use by Conditional Use Grant subject to Building Site and Operation Plan approvals, and WHEREAS, Conditional Use Grant #91 was issued on March 26, 1984 for this property to allow the sales of new and used automobiles and related services, and WHEREAS, Sindic Oldsmobile, Inc. currently owns and occupies the building, and WHEREAS, Sindic Oldsmobile, Inc. will continue to use part of the building while Richlonn’s Tires will use the other part of the building, and WHEREAS, The site currently consists of one commercial structure and a barn, and WHEREAS, The petitioner would like to have a storage area at the rear corner of their parking lot behind the building that will be used for the storage of refuse and tires, and WHEREAS, The petitioner is requesting that the two sides of the storage area that face the parking lot be enclosed with fencing and the other two sides that face the woods not have fencing at this time, and WHEREAS, The fence will be a five (5) foot high cyclone fence and it will contain gray privacy slats for screening to match the principal structure, and WHEREAS, The parking lot currently has 126 parking stalls which is more than sufficient for the use of the property, and WHEREAS, The parking lot will be repaired, sealed and re-striped, and WHEREAS, There are no changes proposed to the landscaping at this time, and WHEREAS, No additional lighting is shown on the new plans and any new lighting would need Plan Commission approval, and WHEREAS, No new signage is approved as part of this submittal, and WHEREAS, There are existing banners on the light poles that have not been previously approved, and WHEREAS, Stormwater management is not needed since there are no impervious surfaces being added. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Robert Sindic property located in the SW ¼ of Section 9 and the NW ¼ of Section 16 (Tax Key No. 2195.981 / S78 W18755 Janesville Road), BE IT FURTHER RESOLVED, That the entire storage area shall be fenced in and that all sides the north, west, and south sides of the fence shall have privacy slats. BE IT FURTHER RESOLVED, That if the wooded area around the enclosed storage area is removed or if the storage becomes unsightly to surrounding view an amendment may be needed to fully screen and enclose the storage area. BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code. BE IT FURTHER RESOLVED, That no other outdoor storage shall be allowed other than noted above. BI IT FURTHER RESOLVED, That any signage changes will require Plan Department and/or Plan Commission approval. BE IT FURTHER RESOLVED, That the banners on the light poles need to be removed and if the petitioner wishes to have the banners up at any time they would need to file for a temporary sign permit. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
