APPROVAL OF A CONCEPTUAL TWO (2) LOT LAND DIVISION FOR THE WERTZ
PROPERTY LOCATED IN THE SW ¼ OF SECTION 25
(TAX KEY NO. 2259.987 / LOOMIS DRIVE)
WHEREAS, On April 5, 2005 a Conceptual Certified Survey Map was submitted by
Margaret Wertz for a two (2) lot land division of the property located in the SW ¼ of
Section 25, (Tax Key No. 2289.987 / Loomis Drive), and
WHEREAS, Said property is split zoned consisting of RSE Suburban Estate Residence
District requiring minimum lot size of 40,000 square feet and an average minimum width
of 150 feet to the north and A Agricultural District to the south and parcels meet said
minimum zoning requirements, and
WHEREAS, The land division consists of one lot and one outlot and the outlot is noted to
be used for agricultural purposes only with no buildings or structures permitted on it, and
WHEREAS, Outlot 1 conflicts with the City’s Land Division Ordinance that in no case
shall a lot be less than 80' in width at the base setback line, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for
agricultural and open lands consistent with rural development and this proposal does not
meet this goal although zoning is in place, and
WHEREAS, Said parcels will be serviced by municipal sewer and private water facilities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conceptual
Certified Survey Map submitted by Margaret Wertz for a two (2) lot land division of the
property located in the SW ¼ of Section 25, (Tax Key No. 2289.987 / Loomis Drive).
BE IT FURTHER RESOLVED, That this approval is granted in concept only and final
action is only an indication of the current intent of the Plan Commission; Final submittals
are subject to future review and consideration by the Plan Commission, municipal
committees of jurisdiction, and other agencies, and approval of final plans is not
guaranteed by this action of the Plan Commission.
