APPROVAL OF A BUILDING SITE AND OPERATION PLAN
FOR A RETAIL CONVENEINCE CENTER LOCATED IN THE NE ¼ OF SECTION 10
(JANESVILLE ROAD / TAX KEY NOS. 2198.990.001 AND 2198.985.062)
WHEREAS, On May 9, 2005 plans were submitted by Mike Michalski for a Building, Site and
Operation Plan for a Retail Convenience Center located in the NE ¼ of Section 10 (Janesville
Road / Tax Key Nos. 2198.990.001 and 2198.985.062), and
WHEREAS, Said property is currently zoned B-4/OWP Highway Business District with a
Wellhead Protection Overlay District, and said use is a permitted use within this zoning district,
and
WHEREAS, Said parcels will be serviced by public sewer and water facilities, and
WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s
Downtown Design Guide, General Design Guide, and Redevelopment District #2 Plan, and
WHERES, The property is a combination of three parcels and a CSM is needed to combine
them, and
WHEREAS, The petitioner requests approval for a 16,500 square foot structure to house 11
retail/commercial leased areas, and said structure appears to meet the requirements of the
zoning ordinance, and
WHEREAS, Said structure is proposed to be built according to the Downtown Design Guide
which promotes structures to utilize materials of a residential character and to be harmonious
with the natural and built surroundings while avoiding repetition and monotony, and
WHEREAS, Said structure is proposed to be built according to the Redevelopment District #2
Guide overseen by the Community Development Authority which promotes alternating rooflines,
increased walk ability of a site, and an overall quality set apart design from other structures found
in the City, and
WHERAS, The City’s Community Development Authority recommended approval of the BSO as
submitted finding that the structure proposed demonstrated a quality design unique for Muskego
and will also provide the downtown with a fine example of what architecture should demonstrate
in the future, and
WHERAS, The City’s Community Development Authority recommended that the developer look
into preserving more green space and some of the existing trees by reducing the amount of
parking as the parking shown is more than required, and
WHEREAS, The Downtown Design Guide requires Four-sided architecture which utilizes similar
building materials and design for all sides of a proposed structure, and
WHEREAS, Said structure is proposed to be constructed with exterior materials which include
Split Face Decorative CMU, Decade Brick, Precast Banding, and Precast Cap Coping on the
east, west, and north elevations of the structure and the south elevation will incorporate the same
materials with the exception of the Decade Brick, and
WHEREAS, Said structure includes architectural elements such as alternating roof lines, large
storefront glass panes, and decorative coping and pedestals, and all the elements appear to
meet the intent of the Downtown Design Guide, and
WHEREAS, Colors of the proposed principal structure are shown in the colored rendering as all
earth tones with appropriate break-ups in the design that meet the intent of the Downtown Design
Guide, and
WHEREAS, All Building mechanicals, including HVAC units, are not shown but appear to be
screened, and
WHEREAS, Access is shown throughout the site and is appropriately marked with arrows and
one-way markings and loading zones have been separated from thru-traffic areas, and
WHEREAS, A drive-thru lane is shown on the east elevation of the building and the lane appears
to have adequate stacking, and
WHEREAS, 74 parking stalls are shown and is more than sufficient, as parking requirements
needed by code would be 1 stall for every 150 square feet of customer floor area and 50% of a
new retail building is usually considered customer floor area and this equals 8,250 square feet,
and
WHEREAS, Cross Access is depicted from the Pick n’ Save parking lot to the west and a new
access point off of Parkland Drive and this is consistent with the intent of the Downtown Design
Guide, and
WHEREAS, No cross access easements are shown on the site plan, and
WHEREAS, A path is shown that will connect to the City’s recreation trail along Janesville Road,
and
WHEREAS, Area for a monument sign is depicted on the site plan and the sign shall be 5’4” in
height located outside of the vision corner, and
WHEREAS, The monument sign will incorporate the materials found on the principal structure
and will be amply landscaped as per the Downtown Design Guide, and
WHEREAS, Lights are noted on the landscape plan but no lighting specifics or photometric plan
is part of the BSO, and
WHEREAS, A landscaping plan has been submitted, and the plan have been reviewed by the
City Forester and revisions are necessary consistent with the Downtown Design Guide, and
WHEREAS, The landscape plan differs from the setup of the site plan, and
WHEREAS, A dumpster enclosure is proposed to house all refuse containers located on the
southwest portion of the property and is to be made of cedar rough sawn boards stained to
incorporate colors of the principal structure.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan for a retail convenience center by Mike Michalski for a property located in the NE
¼ of Section 10 (Janesville Road / Tax Key Nos. 2198.990.001 and 2198.985.062).
BE IT FURTHER RESOLVED, That a revised landscape plan shall be submitted and approved
by the City Forester to ensure Downtown Design Guide compliance and the landscape plan must
mimic the site plan.
BE IT FURTHER RESOLVED, That due to this being a group of businesses, signage
specifications should be derived by the building owner and presented to the Plan Commission to
ensure Downtown Design Guide compliance in the future when tenants begin to lease space.
BE IT FURTHER RESOLVED, That a lighting plan including all light elevations and details for the
parking and signage lights, and a photometric plan denoting foot candles be submitted and
approved by the Planning Department to ensure Downtown Design Guide compliance before the
release of building permits.
BE IT FURTHER RESOLVED, That a landscape island be added between the row of 20 stalls in
front of the structure to meet the General Design Guidelines.
BE IT FURTHER RESOLVED, That the path leading to the City’s recreation trail along Janesville
Road be improved to all existing ADA standards.
BE IT FURTHER RESOLVED, That the drive-thru signage receive the proper approvals if any
menu boards are required in the future.
BE IT FURTHER RESOLVED, That the BSO is subject to a recording of a CSM to combine the
properties shown on the site plan and implement a cross access easement throughout the
drivable portions of the property.
BE IT FURTHER RESOLVED, That outdoor sales shall be expressly prohibited on the property;
including, but not limited to, vending machines, LP, and palettes of various products (water
softener salt, soda, etc.).
BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly
prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code.
BE IT FURTHER RESOLVED, That the concrete base of any light pole be no more than 6” above
grade and that any light pole cannot exceed 15-feet in height.
BE IT FURTHER RESOLVED, That all mechanicals shall be screened from view.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping and/or asphalting, a bond, or cashiers check equal to twice the value of said costs
must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
