PCR2005060AMENDED RESOLUTION #P.C.060-2005 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR OLSON’S OUTDOOR POWER LOCATED IN THE SE ¼ OF SECTION 17 (TAX KEY NO. 2228.999.016 / S83 W19021 SATURN DRIVE) WHEREAS, On April 4, 2005 plans were submitted by Greg Olson for a Building, Site and Operation Plan amendment for a property located in the SE ¼ of Section 17 (Tax Key No. 2228.999.016 / S83 W19021 Saturn Drive), and WHEREAS, Said use is a permitted use in the I-1, Industrial Park District by right with the approval of a Building, Site and Operation Plan, and WHEREAS, The existing site consists of an industrial/commercial building along with undefined parking and random unenclosed outdoor storage. WHEREAS, The petitioner is going to remove an overhead door on the east side of the building and replace it with two (2) windows and siding to match the existing building, and WHEREAS, There will be eight (8) customer parking stalls and five (5) employee parking stalls, and WHEREAS, The entry approach, the access to the fenced area, and the parking areas will all be paved, and WHEREAS, All parking stalls are 10’ x 20’ and will need to be striped, and WHEREAS, There will be a 200’ x 80’ fenced area to enclose any outdoor storage and any crated equipment, and WHEREAS, A six (6) foot high chain link fence with privacy slats is being proposed surrounding the outdoor storage area, and WHEREAS, The proposal includes a designated area for the storage of trailers outside of the fenced in area along the eastern lot line, and WHEREAS, The petitioner proposes to display a maximum of twenty-four (24) pieces of equipment in front of the building on the west side of the entry driveway and a maximum of twenty-four (24) pieces of equipment in the front of the landscape berm on the east side of the driveway, and WHEREAS, The pieces of equipment that are to be displayed in the front of the property will be brought in and enclosed when the business closes daily, and WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and WHEREAS, No stormwater facilities will be needed since the added impervious surface will be less than half an acre, per the City Engineering Department. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for Olson’s Outdoor Power located in the SE ¼ of Section 17 (Tax Key No. 2228.999.016 / S83 W19021 Saturn Drive). BE IT FURTHER RESOLVED, That any new signage will require Plan Department and/or Plan Commission approval. BE IT FURTHER RESOLVED, That the privacy slats within the fence must be colored to match the main building. BE IT FURTHER RESOLVED, That any display areas in the front of the property must be located on the property, not within the public right-of-way. BE IT FURTHER RESOLVED, That any trailers stored in the approved area must be in a neat, clean, and uncluttered condition at all times and in the approved spots. BE IT FURTHER RESOLVED, That other ancillary signage on the property is expressly prohibited unless specifically regulated by Section 17:6.09 of the Municipal Code. BE IT FURTHER RESOLVED, That the outdoor storage will allow for twenty-four (24) be limited to twelve (12) tractors/movers located to the east of the entry driveway, in front of the landscaped berm to reduce clutter and keep with the aesthetics of the surrounding properties. BE IT FURTHER RESOLVED, That no other outdoor storage/display shall be allowed other than noted above. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That the petitioner will get a landscape plan approved by the City Forester that will incorporate landscaping that screens the parked trailers on the east property line.
