APPROVAL OF AN ACCESSORY STRUCTURE FOR THE HAUT PROPERTY
LOCATED IN THE SW ¼ OF SECTION 31
(TAX KEY NO. 2283.999.003 / W216 S10891 CROWBAR DRIVE)
WHEREAS, On April 4, 2005 a site plan and building drawings were submitted by James Haut to
construct a 864 square foot accessory structure (24’ x 36’) on the property located at W216
S10891 Crowbar Drive, and
WHEREAS, The property is zoned A, Agricultural District, and where said structure is a permitted
accessory use and subject to Plan Commission review due to the proposed architectural
materials shown, and
WHEREAS, The total square footage for accessory structures on this property is limited to 3,305
square feet, and said proposal meets the bulk requirements of the Zoning Code, and
WHEREAS, There currently is a gazebo on the parcel, and
WHEREAS, The structure is proposed to be constructed with white colored steel walls with white
trim and an emerald green colored steel roof, and said proposal does not meet the Plan
Commission’s standards for administrative approval of residential accessory structures as the
siding and roof materials do not match the materials used on the primary residence, and
WHEREAS, The accessory structure will have 12” overhangs to match the 12” overhangs on the
existing house, and
WHEREAS, The property is agriculturally zoned and is rural in character, and
WHEREAS, The parcel the accessory structure is proposed to be placed upon is being
subdivided through a CSM simultaneously under #P.C. 056-2005.
THEREFORE BE IT RESOLVED, That the Plan Commission approves an 864 square foot
accessory structure submitted by James Haut for the property located at W219 S10891 Crowbar
Drive.
BE IT FURTHER RESOLVED, That the Plan Commission approves of the accessory structure
due to no undue harm to the surrounding properties and that the surrounding area is not
predominately residential.
BE IT FURTHER RESOLVED, That the proposed accessory structure must be located at least 10
feet away from the wetland shown on the CSM being handled under #P.C. 056-2005.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the
approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation
of legal action, or both.
