RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT AND REZONING
FROM RCE COUNTRY ESTATE DISTRICT TO RCE/COPD COUNTRY ESTATE
DISTRICT WITH A CONSERVATION PLANNED DEVLOPMENT OVERLAY DISTRICT
FOR RUSTIC TRAILS SUBDIVISION LOCATED IN
THE NW ¼ OF SECTION 13
(FIELD DRIVE / TAX KEY NO. 2188.999)
WHEREAS, On April 11, 20005 a preliminary plat was submitted by Field Drive LLC for the Rustic Trails
Subdivision located in the NW ¼ of Section 13 (Field Drive / Tax Key No. 2188.999), and
WHEREAS, Said plat proposes 6 single-family lots ranging from approximately 44,000 square feet to
56,000 square feet and two (2) outlots for conservation and stormwater purposes, and
WHEREAS, Said property is zoned RCE Country Estate District and petitioner requests a rezoning to
RCE/COPD Country Estate District with a Conservation Planned Development Overlay District, which
requires maximum lot sizes of 60,000 square feet and recommended maximum widths of 150 feet, and said
proposed plat appears to meet these requirements, and
WHEREAS, The COPD zoning district allows for increased flexibility within the underlying zoning
requirements while promoting cluster development, improved environmental standards, and allows the
possibility for bonus lots and said plat appears to incorporate clustered development while promoting
preservation of environmental features, and
WHEREAS, The COPD petitioned for does not request any bonus lots as part of the planned development,
and
WHEREAS, A Conservation Subdivision is to incorporate at least 50% open space and the proposed
subdivision contains approximately 60% of the land as open space, and
WHEREAS, Wetlands are entirely within outlots with the exception of Lots 2 and 3 and a wetlands
restriction easement is incorporated over the wetlands found on the lots, and
WHEREAS, Said property is shown on the 2010 Land Use Plan as Rural Density Residential consistent
with the RCE zoning district permitting parcels of 0.4 units an acre, and said proposed plat appears to meet
all requirements for a Conservation Planned Development, and
WHEREAS, The Conservation Commission has found that the plat is consistent with the adopted
Conservation Plan and has recommended approval with the waiver of Conservation Dedication fees subject
to the outlot with identified conservation areas being dedicated to City for conservation purposes, and
WHEREAS, Outlot 1 consists of high quality environmental lands and has an improved trail residing
within and said outlot will be dedicated to the City for conservation purposes, and
WHEREAS, The plat is consistent with the adopted 2003-2007 Park and Open Space Plan and the 2010
Street System Plan, and
WHEREAS, Said parcels will be serviced by private sewer and water, and
WHEREAS, Stormwater management will be accommodated on-site within Outlot 2.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common
Council of a 6 lot Preliminary Plat and a rezoning from RCE Country Estate District to RCE/COPD
Country Estate District with a Conservation Planned Development Overlay District for Rustic Trails
Subdivision located in the NW ¼ of Section 13 and will be receptive to the submittal of a final plat, subject
to resolution of technical discrepancies as identified by the City Planning Department and City Engineers,
and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding
assessments if applicable.
BE IT FURTHER RESOLVED, That the Plan Commission, as part of the approvals of the subdivision,
requests the City Forester to include in the annual conservation lands maintenance schedule the monitoring
of the wetlands on Lots 2 and 3 to ensure no encroachment or destroying of the wetlands is being done.
BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance
with Common Council Ordinance No. 1118 and Resolution 196-2002.
