PCR2005049RESOLUTION #P.C. 049-2005 APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP AND RECOMMENDATION TO COUNCIL FOR A REZONING FROM RSE SUBURBAN ESTATE DISTRICT TO RS-2 SUBURBAN RESIDENCE DISTRICT AND FOR A 2010 PLAN AMENDMENT FROM LOW DENISTY RESIDENTIAL TO MEDIUM DENSITY REIDENTIAL FOR THE WATSON PROPERTY LOCATED IN THE NW ¼ OF SECTION 13 (DURHAM DRIVE / TAX KEY NO. 2211.056) WHEREAS, On March 18, 2005 a Certified Survey Map for a two (2) lot land division and a petition for a rezoning was submitted by James Watson for a property located in the NW ¼ of Section 13, (Tax Key No. 2211.056 / Durham Drive), and WHEREAS, The proposed land division would create lots with minimum areas of approximately 20,000 and 22,600 square feet, and WHEREAS, Said property is zoned RSE Suburban Estate Residence District, requiring a minimum lot size of 40,000 square feet and an average minimum width of 150 feet and requires a rezoning to RS-2 Suburban Residence District to permit land divisions with a minimum lot size of 20,000 square feet and an average minimum width of 110 feet, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for low-density residential and requires a 2010 Plan Amendment to medium density residential, and WHEREAS, Lot 2 will receive access from Durham Drive and Lot 1 will receive access from Holz Drive, and WHEREAS, Said parcels will be serviced by public sanitary sewerage and water supply facilities, and WHEREAS, Rights of way have been dedicated in accordance with the 2010 Street System Plan. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map being submitted creating two parcels and recommends approval for a rezoning from RSE Suburban Estate Residence District to RS-2 Suburban Residence District and a 2010 Plan Amendment from low-density residential to medium-density residential on the Watson property located in the NW ¼ of Section 13, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That the Plan Commission recommends approval to the higher density zoning and 2010 Plan Amendment due to the existing similar densities found immediately to the south of the parcel along Holz Drive. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
