RECOMMENDATION OF APPROVAL OF A REZONING FROM A AGRICULTURAL TO
RS-2/OPD SUBURBAN RESIDENCE WITH A PLANNED DEVLOPMENT OVERLAY
DISTRICT, AND A 2010 PLAN AMENDMENT FROM AGRICULTURE AND OPEN SPACE
TO MEDIUM DENSITY RESIDENTIAL FOR THE FUTURE WOODLAND CREEK
ESTATES ADDITION #1 LOCATED IN THE NE ¼ OF SECTION 20
(RACINE AVENUE / TAX KEY NO. 2237.994)
WHEREAS, On February 11, 2005 a rezoning petition was submitted by Towne Realty for a property that
will house the future Woodland Creek Estates Addition #1 located in the NE ¼ of Section 20 (Tax Key
Number 2237.994), and
WHEREAS, Said property is zoned A Agricultural and petitioner requests a rezoning to RS-2/OPD
Suburban Residence District with a Planned Development Overlay District, which requires a minimum lot
size of 20,000 square feet and minimum width of 110 feet, and
WHEREAS, The OPD zoning district allows for increased flexibility within the underlying RS-2 zoning
requirements, and
WHEREAS, Said property is shown on the 2010 Land Use Plan as Agriculture and Open Space and
requires an amendment to Medium Density Residential, and
WHEREAS, The Plan Commission previously approved a preliminary plat and a rezoning to RS-2/OPD
for the properties located to the east of the petitioned parcel that included 60 single-family lots ranging
from approximately 18,000 square feet to 22,000 square feet and three (3) outlots for wetlands protection
purposes, and
WHEREAS, The Plan Commission previously approved a concept for the petitioned parcel allowing
densities consistent with the RS-2/OPD zoning district.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common
Council of a rezoning from A Agricultural to RS-2/OPD Suburban Residence with a Planned Development
Overlay District, and a 2010 Plan amendment from Agriculture and Open Space to Medium Density
Residential for the future Woodland Creek Estates Addition #1 located in the NE ¼ of Section 20.
