PCR2005037RESOLUTION #P.C. 037-2005 APPROVAL OF A THREE (3) LOT LAND DIVISION FOR THE BC & J DEVELOPMENT PROPERTY LOCATED IN THE SE ¼ OF SECTION 23 (TAX KEY NO. 2252.999 / BOXHORN DRIVE) WHEREAS, On February 14, 2005 a Certified Survey Map was submitted by BC & J Development for a three (3) lot land division of the property located in the SE ¼ of Section 23, (Tax Key No. 2252.999 / Boxhorn Drive), and WHEREAS, Said property is split zoned consisting of RS-2 Suburban Residence District requiring minimum lot size of 20,000 square feet and an average minimum width of 110 feet to the east and SW Shoreland Wetland to the west and parcels meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for low- denisty residential development and this proposal is within this goal, and WHEREAS, The configurations of the lots conflict with what is shown in the Waukesha County Mapping documents however, title has been given by the surveyor, and WHEREAS, A Conditional Use Grant exists for a mother in-law unit within the residence that is on Lot 1 and will remain, and WHEREAS, Said parcels will be serviced by municipal sewer and private water facilities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map submitted by BC & J Development for a three (3) lot land division of the property located in the SE ¼ of Section 23, (Tax Key No. 2252.999 / Boxhorn Drive), subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a DNR wetland concurrency and ordinary high water mark delineation be given before the recording of the CSM. BE IT FURTHER RESOLVED, That a reapproval by the Common Council will be needed if any technical discrepancies result in lot reconfigurations. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196- 2002.
