APPROVAL OF A PRELIMINARY PLAT FOR THE WEATHERWOOD COURTS
SUBDIVISION, LOCATED IN THE NE 1/4 OF SECTION 25
(TAX KEY NO. 2257.999)
WHEREAS, On February 11, 2005 a Preliminary Plat was resubmitted by Robert Stack
for Weatherwood Courts located in the NE 1/4 of Section 25, and
WHEREAS, On August 22, 2003 a Preliminary Plat was submitted by Robert Stack for
Weatherwood Courts and was approved as per Resolution #P.C.116-2003, and
WHEREAS, If a final plat is not submitted within one year from the approval of the
preliminary plat, the preliminary plat becomes null and void and must be resubmitted to
the City, however the plat does not need resubmitting to objecting authorities, and
WHEREAS, Said plat consists of 11.216 acres, and proposes 20 lots, ranging from
15,070 square feet to 30,615 square feet in size, and
WHEREAS, Said property is zoned RS-3 Suburban Residence District, requiring a
minimum lot size of 15,000 square feet and an average minimum width of 100 feet, and
said lots appear to meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for medium density
residential development, and this proposal is consistent with the Plan, and
WHEREAS, The adopted Conservation Plan does not depict any acquisition or
management areas within the plat, and
WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not depict any
acquisition areas within the plat, and
WHEREAS, The Ryan Road and North Cape Road have been previously dedicated to
their ultimate widths as depicted on the 2010 Street System Plan, and
WHEREAS, Said parcels will be serviced by public sanitary sewer and water, and
WHEREAS, Access to Ryan Road and North Cape Road is restricted, and
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a 11.216 acre, 20 lot, Preliminary Plat for the Weatherwood
Courts Subdivision located in the NE 1/4 of Section 25 and will be receptive to the
submittal of a final plat, subject to resolution of technical discrepancies as identified by
the City Planning Department and City Engineers, and payment of all applicable fees in
Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, The Margin Note labeled “Subdivision Statistic #4”
shall be removed as the water source will be via municipal water.
BE IT FURTHER RESOLVED, The Margin Note labeled “Restrictions #6” shall be
amended to include Parcel 2.
BE IT FURTHER RESOLVED, A note should be included on the plat noting the
maintenance responsibilities of the homeowner’s association for the landscape islands.
BE IT FURTHER RESOLVED, The Preservation Restriction notes shall be removed
from the plat.
BE IT FURTHER RESOLVED, The plat must receive a water source recommendation
from Public Utilities Committee.
BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the
City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002
after the time of final plat.
