PCR2005024aAMENDED RESOLUTION #P.C.024-2005 APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN FOR THE INPRO CORPORATION LOCATED IN THE NW ¼ OF SECTION 16 AND NE ¼ OF SECTION 17 (TAX KEY NOS. 2221.001, 2221.002, 2221.003, 2221.004 and 2221.006.001 / APOLLO DRIVE) WHEREAS, On February 8, 2005 plans were submitted by the Inpro Corporation for an amendment to a Building, Site and Operation Plan for the Inpro property located in the NW ¼ of Section 16 and NE ¼ of Section 17 (Tax Key Nos. 2221.001, 2221.002, 2221.003, 2221.004 and 2221.006.001 / Apollo Drive) to omit the landscape islands in the previously approved parking stalls on the north side of the property, and WHEREAS, On June 20, 2005 plans were submitted by the Inpro Corporation for additional BSO amendments, which included adding an additional 19 parking stalls in the rear of the main structure, eliminate the use of one existing on-grade overhead door and two existing loading dock overhead doors facing Apollo Drive, shifting the entranceway away from the Mercury/Apollo Drive intersection, increasing the cafeteria square footage, and adding a small new entrance to the existing building, and WHEREAS, On July 8, 2005 plans were submitted by the Inpro Corporation for additional BSO amendments, which included adding a new parking lot in a vacant parcel across Apollo Drive from the main structure, and WHEREAS, The Inpro Corporation received BSO approval as per Resolution #P.C. 094- 2004 for a large expansion to the existing building complete with new parking, lighting, landscaping, and site layout, and WHEREAS, Said property is zoned I-1/OPD Industrial Park District with a Planned Development Overlay District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and WHEREAS, The OPD, Planned Development Overlay District is specifically to allow a decreased setback to 25 feet for the new addition that is requested, and WHEREAS, Petitioner requests to change the originally approved Building Site and Operation Plan to omit landscape islands between the new parking configuration, and WHEREAS, The new parking lot is located to the rear of the structure bordering WEPCO property, and WHEREAS, The General Design Guide promotes having landscape islands within parking lots between every 10 parking stalls, although Plan Commission can waive a design guideline if the proposal adapts to the site well in a different configuration and doesn’t cause undue harm to surrounding properties, and WHEREAS, The 19 new parking stalls added to the BSO will be screened by vegetation and will be considerably lower in grade than the properties to the north, and WHEREAS, The elimination of the existing overhead doors will reduce the amount of trucks backing in and out close to the existing Apollo Drive right-of-way, and WHEREAS, The new site plan shows that where the overhead doors are being removed, new green space will now exist, and WHEREAS, The Apollo Drive entrance near the Mercury/Apollo Drive intersection is shifted to increase safety at the intersection, and WHEREAS, The proposed building amendments for the entrance and cafeteria meet all zoning requirements, and WHEREAS, The newly requested parking lot across Apollo Drive will consist of 125 9-foot by 20-foot stalls, will have 3 foot setbacks from existing property lines, will access off of Apollo Drive via a recorded ingress/egress easement shared with the property to the east, and will be landscaped throughout, and WHEREAS, The new parking lot will require stormwater management, which may be allowed off-site in the existing basin, and WHEREAS, The new parking lot will be strictly for Inpro employee usage. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Inpro Corporation located in the NW ¼ of Section 16 and the NE ¼ of Section 17 (Tax Key Nos. 2221.001, 2221.002, 2221.003, 2221.004 and 2221.006.001/ Apollo Drive). BE IT FURTHER RESOLVED, That the Plan Commission will allow the omission of the landscape islands in the previously approved parking stalls due to the location of the proposed parking lot being behind the new structure away from public view. BE IT FURTHER RESOLVED, That the reduction in parking stall width and the omission of landscape islands every 10 stalls is allowed due to the strict employee use only that will govern the parking lot. BE IT FURTHER RESOLVED, That the new parking lot will be for an accessory use strictly for Inpro employees only and that any new use for the property must be approved by the City’s Planning Commission. BE IT FURTHER RESOLVED, That a landscape plan for the new parking lot be approved by the City Forester before any improvements begin and that the landscape plan include landscaping throughout the lot including all landscape islands and between the middle row of parking stalls. BE IT FURTHER RESOLVED, That stormwater calculations be delivered to the Engineering Department before any improvements begin so the Engineering Department may appropriately figure the buy-in amount needed to utilize the existing stormwater basin for the area. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
