APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR BAY
LANE MIDDLE SCHOOL IN THE SE ¼ OF SECTION 10
(TAX KEY NO. 2200.998.001 / S75 W16399 HILLTOP DRIVE)
WHEREAS, On February 4, 2005 plans were submitted by INSPEC for an amendment to
a Building, Site and Operation Plan for Bay Lane Middle School located in the SE ¼ of
Section 10 (Tax Key No. 2200.998.001 / S75 W16399 Hilltop Drive), and
WHEREAS, Said property is zoned RS-2/OIP Suburban Residence District with an
Institution and Public Service Overlay, and said use is a permitted use by right subject to
Building Site and Operation Plan approvals, and
WHEREAS, An amendment to a Building, Site, and Operation Plan was approved as per
Resolution #P.C. 008-2005 to allow increased parking, new lighting, and an access
pathway, and
WHEREAS, The Petitioner now proposes to install a culvert where an existing City trail
exists to allow for access over the stormwater detention area, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended
Building, Site and Operation Plan for Bay Lane Middle School located in the SE ¼ of
Section 10 (Tax Key No. 2200.998.001 / S75 W16399 Hilltop Drive).
BE IT FURTHER RESOLVED, That the trail that was required as per Resolution #P.C.
008-2005 is no longer needed as a grass covered access way will extend over a culvert to
the City maintained trails.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to drainage shall be maintained
in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal
action, or both.
