APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN
FOR BUSHY’S PUB AND GRILL LOCATED IN THE SW ¼ OF SECTION 2

WHEREAS, On January 26, 2005 it was determined that an amendment was needed to the
previously approved plans submitted by Lynn Kurer for a Building, Site and Operation Plan for
Bushy’s Bar and Grill located in the SW ¼ of Section 2, and
WHEREAS, The original BSO was approved as per Resolution #P.C. 66b-2004 on June 15,
2004, and
WHEREAS, The originally approved plans included a dormer window and box windows on the
south elevation of the building and box windows on the west elevation of the building and the
petitioner now wishes to remove from the approvals, and
WHEREAS, Said property is currently zoned HC-1 Historic Tess Corner s District, and said use is
a permitted use when the primary floor area of a restaurant is 3,000 square fee or below and the
proposed meets this requirement, and
WHEREAS, Said property is subject to the design standards outlined in the City of Muskego’s
Tess Corner’s Design Guide, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an Amended Building,
Site and Operation Plan by Lynn Kurer for Bushy’s Pub and Grill located in the SW ¼ of Section
2.
BE IT FURTHER RESOLVED, That the Plan Commission finds that the amendments to the
previously approved Building Site and Operation Plan still meet the requirements found in the
Tess Corners Design Guide.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
BE IT FURTHER RESOLVED, The amendment is contingent upon receiving a positive
recommendation from the Community Development Authority.
