PCR2005013RESOLUTION #P.C. 013-2005 RECOMMENDATION OF APPROVAL TO REZONE THE CREATIVE HOMES PROPERTY FROM R-2 COUNTRY ESTATE DISTRICT, R-3 COUNTRY ESTATE DISTRICT, AND RS-3 SUBURBAN RESIDENCE DISTRICT TO THE RSE/COPD SUBURBAN ESTATE DISTRICT WITH A CONSERVATION PLANNED DEVELOPMENT OVERLAY LOCATED IN THE NE ¼ OF SECTION 24 (TAX KEY NO. 2253.999.006/ BOXHORN DRIVE) WHEREAS, On December 16, 2004 a petition for rezoning was submitted by Creative Homes to rezone the Creative Homes property from R-2 Country Home District, R-3 Country Home District, and RS-3 Suburban Residence District to the RSE/COPD Suburban Estate District with a Conservation Planned Development Overlay, and WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on January 25, 2005, and WHEREAS, The petition would permit sewered residential development on lots of a maximum 20,000 square feet in area and 100 feet of width in order to promote conservation based development, and WHEREAS, The 2010 Comprehensive Plan depicts the property for low density residential use consistent with the yield plan that was approved as per P.C. Resolution # 031-2002, and this proposal is consistent with this goal, and THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning of the Creative Homes property identified by Tax Key Number 2253.999.006 from R-2 Country Home District, R-3 Country Home District, and RS-3 Suburban Residence District to the RSE/COPD Suburban Estate District with a Conservation Planned Development Overlay. BE IT FURTHER RESOLVED, That the petitioner must demonstrate what conservation measures will be taken if bonus parcels are intended at the time of Final Plat.
